2000-21 Rezoning USS 3098 - Mill Bay RoadKODIAK ISLAND BOROUGH ORDINANCE NO. 2000 -21 Introduced by: Manager Jensen Requested by: Planning and Zoning Commission Drafted by: Community Development Department Introduced: 12/07/2000 Public Hearing: 12/21/2000 Adopted: 12/21/2000 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOT 1, U.S. SURVEY 3098 FROM PL- PUBLIC USE LANDS TO B- BUSINESS (LOCATED AT 1827 MILL BAY ROAD) WHEREAS, the owner of Lot 1, U.S. Survey 3098 has requested that this lot be rezoned From PL- Public Use Lands To B- Business; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public hearing on this rezone request at their November 15, 2000 regular meeting; and WHEREAS, upon consideration of the request, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve the rezoning of Lot 1, U.S. Survey 3098. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: Lot 1, U.S. Survey 3098 is hereby rezoned From PL- Public Use Lands To B- Business. Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission are hereby confirmed as follows: 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. A rezone from PL- Public Use Land to B- Business is needed and justified because the B- Business zoning district permits development that: A. is commercial in nature, consistent with the established float plane dock use of the property, which supports commercial air taxi services; and B. will provide new business development opportunities in the urban area, maximizing the existing infrastructure to support the development; and Kodiak Island Borough, Alaska Ordinance No. 2000 -21 Page 1 of 2 C. should reduce off -site traffic impacts when the separate lots are created to provide private accommodations for the float plane use in the area. 17.72.020 B. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. A change of zoning from PL- Public Use Land to the B- Business zoning district is necessary because it is consistent with the 1997 Revised Lakeside /Safeway Subarea Land Use Plan, which designates Lot 1 for General Business.
