AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
CALLING FOR A SPECIAL ELECTION ON FEBRUARY 20, 2001 FOR THE PURPOSE
OF ELECTING THE KODIAK ISLAND BOROUGH MAYOR FOR
A TERM TO EXPIRE OCTOBER, 2001
WHEREAS, Kodiak Island Borough Code Section 2.15.090 provides that the assembly
shall, by two - thirds concurring vote, declare the office of mayor vacant only when the
person elected resigns and the resignation is accepted; and
WHEREAS, Kodiak Island Borough Mayor Gary L. Stevens submitted his resignation to
be effective January 1, 2001; and
WHEREAS, the Kodiak Island Borough Assembly accepted the resignation at its special
meeting of November 28, 2000; and
WHEREAS, the Kodiak Island Borough Assembly declared the office of the mayor vacant
effective January 1, 2001 at its special meeting of November 28, 2000 with a two - thirds
concurring vote; and
WHEREAS, Kodiak Island Borough Code Section 2.15.100 provides that if a vacancy
occurs more than six months before a regular election, the assembly shall call a special
election to fill the unexpired term; and
WHEREAS, the vacancy will occur more than six months before the next regular election
to be held on October 2, 2001; and
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that a special election be held on February 20, 2001 for the purpose of
electing the Kodiak Island Borough Mayor for a term to expire October, 2001.
NOW, THEREFORE, BE IT FURTHER ORDAINED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH that
Section 1: This ordinance is not of a permanent nature and shall not become a part of
the Kodiak Island Borough Code of Ordinances.
Section 2: On December 15, 22, and 29, 2000, the clerk shall publish in one
newspaper of general circulation in the borough a notice of the special

election for the election of the Kodiak Island Borough Mayor for a term to
expire October 2001, including candidate qualifications, and the manner of
making nominations.
Section 3: The borough clerk shall provide nominating petitions beginning December
18, 2001 and shall include a provision for a statement by the candidate
affirming his /her qualifications to fill the office for which he /she is filing.

Any qualified person may have his /her name placed on the ballot as a
candidate for the special election by filing no earlier than December 26,
2000 nor later than January 12, 2001 before the special election, with the
borough clerk, a nominating petition signed by ten (10) qualified voters of
the borough and shall file a Conflict of Interest Statement in accordance
with the provisions of Alaska Statutes at the time of filing the nominating
petition.
The borough clerk shall post the notice of the special election in three public
places and publish at least twice in a newspaper of general circulation in the
Borough, the first such publication to be accomplished on January 19,
2001.
Section 6: Each notice of special election shall include the date of the election, the
hours the polls will be open, the office to which a candidate would be
elected, voter qualifications, and the location of precinct polling places.

A qualified voter may apply for an absentee ballot by mail if postmarked no
sooner than December 8, 2000 nor later than February 13, 2001. The
application shall include the address to which the absentee ballot shall be
returned and the applicant's full Alaska residence address and signature.
Absentee voting in person will be available in the borough clerk's office
February 5, through February 16, 2001 from 8:00 a.m. to 5:00 p.m.
One day prior to the election, the borough clerk shall cause to be posted at
each polling place where the election is to be held, publish in a newspaper
of general circulation, and post in at least three public places in the borough
sample ballots with instructions to voters. Sample ballots shall be
substantially similar to the official ballots and shall be marked "sample
ballot" in place of the words "official ballot ".
Section 10: Canvassing of the returns shall take place on February 28, 2001.
Section 11: Once the Department of Justice Pre - clearance is received, the election shall
be certified and the oath of office administered at the next special or regular
assembly meeting. The newly - elected mayor shall take office the Monday
following certification.

Section 12: All other procedures for the conduct of the special election shall be in
accordance with the Kodiak Island Borough Code.
