2000-17 Disposition of Tax Foreclosed PropertiesKODIAK ISLAND BOROUGH ORDINANCE NO. 2000 -17 Introduced by: Requested by: Drafted by: Introduced: Public Hearing: Adopted: Manager Jensen Planning & Zoning Commission Community Development Department 11/02/2000 12/07/2000 12/07/2000 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY DETERMINING THE DISPOSITION OF TAX FORECLOSED PROPERTIES FROM 1998 AND PRIOR TAX YEARS WHEREAS, the Kodiak Island Borough has acquired real properties as a result of the tax foreclosure procedure from 1998 and prior tax years; and WHEREAS, AS 29.45.460 Disposition and sale of foreclosed property states: (a) The municipality shall determine by ordinance whether foreclosed property deeded to the municipality shall be retained for a public purpose. The ordinance must contain the legal description of the property, the address or a general description of the property sufficient to provide the public with notice of its location, and the name of the last record owner of the property as the name appears on the assessment rolls. (b) Tax - foreclosed property conveyed to a municipality by tax foreclosure and not required for a public purpose may be sold. Before the sale of tax - foreclosed property held for a public purpose, the municipality, by ordinance, shall determine that a public need does not exist; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has reviewed the list of 1998 and prior tax years for foreclosed properties as required by KIBC 18.10.030, has conducted a public hearing on the disposition of the subject parcels, and has made a formal recommendation to the Assembly on the parcel's disposition; and WHEREAS, the Kodiak Island Borough Manager has reviewed the Commissions action, as required by KIBC 18.10.030; and WHEREAS, the Kodiak Island Borough Manager has recommended that one tax foreclosed parcel is declared "public" and retained by the Kodiak Island Borough for public use according to KIBC 18.10.030; and WHEREAS, the Kodiak Island Borough Manager has recommended that one tax foreclosed parcel, previously designated for public purpose by Ordinance 89 -06 -0, be "undeclared" for public purpose and offered at a future Borough land sale; and WHEREAS, the Kodiak Island Borough Manager has recommended that four tax foreclosed parcels are declared not to be of "public need" and be offered at a future KIB land sale. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of a general application and shall not be codified.
