AN ORDINANCE REZONING TRACT A -1 A, TRACT A -1 B, TRACT A -1 C, TRACT
A -1D -1, TRACT A -1D -2, AND TRACT B OF U. S. SURVEY 1671 FROM RR1 -
RURAL RESIDENTIAL ONE TO C - CONSERVATION
(Pleasant Harbor on Spruce Island)
WHEREAS, the owners of Tract A -1 A, Tract A -1 B, Tract A -1 C, Tract A -1 D -1, Tract
A -1 D -2, and Tract B of U. S. Survey 1671 have requested that these tracts be rezoned
From RR1 -Rural Residential One To C- Conservation; and
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public
hearing on this rezone request at their July 19, 2000 regular meeting; and
WHEREAS, upon consideration of the request, the Kodiak Island Borough Planning and
Zoning Commission has recommended that the Kodiak Island Borough Assembly
approve the request.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is not of general application and shall not be codified.
Section 2: Tract A -1 A, Tract A -1 B, Tract A -1 C, Tract A -1 D -1, Tract A -1 D -2, and
Tract B of U. S. Survey 1671 are hereby rezoned From RR1 -Rural
Residential One To C- Conservation.
Section 3: The findings of the Kodiak Island Borough Planning and Zoning
Commission are hereby confirmed as follows:
17.72.020 A. Findings as to the Need and Justification for this Change or Amendment
A rezone from RR1 - Rural Residential One to C- Conservation is needed and justified
because the C- Conservation zoning district permits development that:
A. Is appropriate, in most cases, for remote properties off the Kodiak road
system; and the C- Conservation zoning district, with a five (5) acre

17.72.020 B. Findings as to the effect this Change or Amendment will have on the
objectives of the Comprehensive Plan
A change in the zoning, of these tracts, from RR1 - Rural Residential One to C -
Conservation is consistent with the objectives of the comprehensive plan. The C -
Conservation zoning district, with its five (5) acre minimum lot size, is more
appropriate for remote parcel development, including lodges which are prohibited in the
RR1 - Rural Residential One zoning district.
Section 4: This rezone shall become effective upon adoption, and the official zoning
map shall be updated to reflect this rezoning.

minimum lot size, was originally established for remote areas of the
Borough.
Is suited specifically to this area, which is characterized by a remote
location and steep topography. This property is actually much better
suited to C- Conservation zoning than it is to the existing RR1 - Rural
Residential One zoning. The RR1 - Rural Residential One zoned
subdivision nearby (Sunny Cove Subdivision, Plat 81 -2) has not seen
significant development in its nearly twenty (20) years of existence, in
part due to its remoteness, and in part due to an Alaska Department of
Environmental Conservation (ADEC) requirement for engineered septic
systems, for the one acre lots in the subdivision. In addition, there are
not adequately improved roads in the area to meet access standards for
Tots zoned RR1 - Rural Residential One.
