TO INCREASE THE MANAGER'S PURCHASING AUTHORITY
WHEREAS, Kodiak Island Borough Code Section 3.16.020 requires that the Borough
Assembly approve any purchase, sale, transfer, or contract exceeding $5,000; and

WHEREAS, Kodiak Island Borough Code Section 3.16.030 requires that purchases, sales, or
contracts in excess of $5,000 but less than $10,000 be made in the open market without
newspaper advertising; and
WHEREAS, Kodiak Island Borough Code Section 3.16.030 also allows a local preference of
20% for purchases of $500 or less, and 10% for purchases of more than $5,000 but not
more than $25,000; and
WHEREAS, Kodiak Island Borough Code Section 3.16.040 requires that a purchase of
$10,000 may be made only after a notice calling for bids is printed in a newspaper of general
circulation published within the Borough once a week for not less than three consecutive
weeks prior to the date for bid award; and
WHEREAS, limiting the Borough manager's authority in the process of relatively small
purchases creates an unwarranted amount of paperwork, hinders effective management
practices, and causes ineffective purchasing actions; and
WHEREAS, it is desirable that the Borough manager's purchasing authority be increased to
allow for more effective purchase, sale, transfer, or contract procedures;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is of a general and permanent nature and shall become a part of
the Kodiak Island Borough Code of Ordinances.
Section 2: Sections 3.16.020, 3.16.030, and 3.16.040 of the Kodiak Island Borough Code
of Ordinances are amended to read as follows:

3.16.010 Contract, purchase and sale and transfer procedure. The manager may carry out
any of the following:
A. Contract for, purchase, or issue purchase authorizations for all supplies,
materials, equipment, and services for the offices, departments, and agencies of the
borough;
B. Sell surplus, obsolete, or unusable personal property for the offices, department, and
agencies of the borough;
C. Transfer supplies, material, and equipment to or between the offices, departments,
and agencies of the borough; or
D. Contract for the construction, repair, or improvements of borough facilities.
3.16.020 Limitation on manager's authority. The manager may not make an acquisition,
sale, transfer, or contract authorized by section 3.16.010 of this chapter if the value of the
property, service, or contract exceeds five fifteen thousand dollars ($15,000) without first
obtaining assembly approval.
3.16.030 Open market procedures.
A. Purchases, sales, or contracts authorized by section 3.16.010 of this chapter having
an estimated value in excess of fivc hundred fifteen thousand dollars ($1',5,000) but less than
ten. twenty -five thousand dollars 01- 025,000) shall be made in the open market without
newspaper advertisement.
B. Market purchases, sales, and contracts shall, whenever possible, be based on at least
two (2) competitive bids and shall be awarded to the lowest responsible bidder, or in the case
of a sale, to the highest responsible bidder, except a local preference for purchasing shall be
allowed not to exceed twenty percent (20 %) of the purchase price for purchases of five
fifteen thousand dollars ($155,000) or less and not to exceed ten percent (10 %) of the
purchase price for purchases of more than five fifteen thousand dollars ($15,000) but not
more than twenty -five thousand dollars ($25,000).
3.16.040 Advertising for bids.
A. Purchases, sales, or contracts authorized by section 3.16.010 of this chapter having
an estimated value of more than ten twenty -five thousand dollars ($-1 -0 25,000) may be made
only after a notice calling for bids is printed in a newspaper of general circulation published
within the borough once a week for not less than three (3) consecutive weeks prior to the

date #er of the bid opening. The notice shall contain a general description of the
property, work, or service; state where the bid forms and specifications may be obtained;
specify the place for submission of bids and the time by which they must be received.
