WHEREAS, AS 07.15.340 empowers the Borough to enact a
zoning ordinance and provide for its administration, enforcement
and amendment, and
WHEREAS, the Kodiak Island Borough has pursuant thereto!
adopted Chapter 5 of its Code of Ordinances and Resolutions, which
provides for planning and zoning provisions and procedures, and,
WHEREAS, according to the comprehensive planning and
zoning map adopted by the Kodiak Island Borough, Lots Seven (7) and
Eight (8) of Block Forty -eight (48) of the East Addition to the
Townsite of Kodiak have been classified as R -1 and
WHEREAS, a petition has been received from Huey DeVille
d/b /a Alaska Welding and Rental requesting the rezoning of said
lots to unclassified and has stated that these lots adjoin Lots
Ten (10), Eleven (11) and Twelve (12) of the Allman and LaLande
Subdivision which are used for shop buildings in connection with
his business and a public hearing having been held on June 25, 19691,
and as a result of said public hearing the Planning and Zoning
Commission has recommended the reclassification due to the fact
that these lots are not desirable for building, they can be used
for storage space, the area proposed for rezoning is contingent an I
unclassified area immediately across the street, there were no
objections voiced at the public hearing to the reclassification of
these lots and it having been determined that the public necessity
convenience, general welfare and good zoning practice requires suc
reclassification,

-NOW, THEREFORE, BE IT ORDAINED by the Borough Assemt
of the Kodiak Island Borough that Lots Seven (7) and Eight (8),
Block Forty -eight (48) East Addition to the Townsite of Kodiak now
classified as R -1 be and the same are hereby reclassified as unclassi
fied and that notice of this Ordinance be given by publication in
the Kodiak Mirror seven (7) days prior to the second reading and
that a public hearing be held thereon on the date of the second
reading and that this Ordinance become effective at the expiration
of thirty (30) days after its adoption.
