1969-15 Amending Chapter 6 Adding "Not"AN ORDINANCE AMENDING CHAPTER 6, SECTION 9 OF THE
KODIAK ISLAND BOROUGH CODE OF ORDINANCES AND RESOLUTIONS BY
ADDING THERETO THE WORD "NOT" TO CORRECT AN ERROR APPEARING
THERETO
WHEREAS, Chapter 6 of the Kodiak Island Borough Code
of Ordinances and Resolutions provides a means for the disposal
of real property owned by the Borough and
WHEREAS, Section 9 thereof was drafted to prohibit any
preference rights arising prior to the issuance of a lease or
deed but inadvertently the word "not" was omitted when the ordinar
was typed so that it reads that the filing of an application for
a lease or purchase shall give the applicant the right to lease
or purchase, or use of the land applied for, whereas the same
should have read "shall not ".
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough:
Section 1. That Section 9 of Chapter 6 of the Kodiak
Island Borough Code of Ordinances be and the same is hereby
amended by adding thereto the word "not" so that the same shall
hereafter read as follows:
"Section 9. Rights Prior to Lease or Sale: No
preference rights shall pertain prior to the
issuance of lease or deed. The filing of an
application for a lease or purchase shall not
give the applicant the right to lease or purchase,
or use of the land applied for. Any use not
authorized by lease or purchase shall constitute
a trespass against the Borough."
