1968-25 Repealing Chapter 2 and ReenactingKODIAK ISLAND BOROUGH ORDINANCE NUMBER 68 -25 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH, KODIAK, ALASKA, REPEALING CHAPTER 2 OF THE KODIAK ISLAND BOROUGH CODE OF ORDINANCES AND RESOLUTIONS AND RE- ENACTING THE SAME BE IT ORDAINED by the Kodiak Island Borough Assembly of Kodiak, State of Alaska, as follows: Section 1: Chapter 2 of the Kodiak Island Borough Code of Ordinances and Resolutions which provides for Borough Organi- zation and employees is hereby repealed and re- enacted as follows: CHAPTER 2 BOROUGH ORGANIZATION AND EMPLOYEES Section 1. BOROUGH SEAL: The following is hereb A two-inch (2 a ") circle circumscribed bed aroundaBoneuand one - quarter inch (1 -1/4 ") circle with the words "Kodiak Island Borough" on the upper half of the seal between the larger and smaller inscribed circles, and the date 1963, placed between the larger and smaller circles at the six o'clock position, with a star on the right and one on the left of said date, and inscribed within the smaller circle at the top the word "Corporate" with a dash beneath the same, and in capital letters the word "SEAL" across the middle of the circle with a dash below the same, and in the lower half of the same, and in the lower half of the smaller circle the words "State of Alaska ". Section 2. BONDING SCHEDULE FOR BOROUGH OFFICERS: The following schedule of bonding is adopted for the Borough officers in accordance with AS07.25.060: The figure shown shal_ be the maximum amount purchased. (A) Chairman, $200,000 (B) Clerk- Treasurer, $200,000 (C) Cashier, $10,000 each (D) Assessor, $10,000 (E) All other such employees as may be determined by the Chairman, $10,000 Annual premiums or pro -rate pre- miums as applicable on surety bonds shall be paid by the Borough. Section 3. EXECUTION OF NEGOTIABLE INSTRUMENTS: The Presiding Officer, Chairman and Clerk- Treasurer of the Borough are authorized and empowered to sign checks upon the Borough checking account; and to sign, enforce, accept make, execute and deliver checks, notes, drafts, accept- ances and /or bills of exchange for deposit, discount, .Page One, ORDINANCE NO. 68 -25 -0 rediscount, or any other purpose, and to do all lawful acts requisite for effecting these premises, all check on the bank account of the Borough to become counter signed by any two (2) such persons. Section 4. GENERAL. PERSONNEL REGULATIONS A. Types of Employment: 1. Probationary: All employees appointed to full time permanent positions shall first serve a probationary period for the purpose of observ- ing the employee's work, his adjustment to the new work required and for rejecting any employ whose performance does not meet the required standards. The probationary period shall begi immediately upon appointment and continue for three (3) months. At any time during the probationary period, an employee whose perfor- mance does not meet the required standards may be dismissed. There shall be no recourse to dismissal prior to completion of the probation ary period. 2. Permanent: Employees in this category are cla ified as full time regular employees serving as part of the staff c omplement con in u required for performance of Borough services. Permanent employees are approved only upon completion of their probationary period. B. Rates of Pay: Employees shall be paid semi - monthl no more than 1 /24th of the annual rate established in the Annual Borough Budget unless otherwise provided fo Pay days shall be the 15th and the last working 3a each month. C. Leave: Leave with pay shall accrue to all regular employees at the rate of 1 -1/2 days for each full calendar month of service, but new employees may not take such leave, until after three months of employment. For new hires, any employee employed between the 1st and 15th days of the month, inclu- sive, shall be considered to have worked the full month for leave purposes; and any employee employe after the 15th day of the month shall accrue no le N, for that month. Leave may be used for vacation, periods of illness or to conduct personal business An employee desiring to take leave shall submit an application on blanks provided by the Borough. Su.1 applications shall be approved by the appropriate department head and the Borough Chairman, prior to taking leave. In case of illness, retroactive approval may be obtained. The maximum number of days of leave that may be accrued for any one employee at any one time is 36 days. The principal purpose for providing leav Page Two, ORDINANCE NO. 68 -25 -0 Page Three, ORDINANCE NO. 68 -25 -0 benefits is to provide periods of vacation for Borough employees. Accrued leave shall not be paid to any employee who has resigned or is termin ated from Borough employment with less than one year's service. Leave without pay, if approved by the Borough Chairman, may be granted to employees not to ex- ceed 30 days. The procedure and approval shall be the same as prescribed for the granting of leav with pay. Leave without pay in excess of 30 days shall be subject to approval by the Borough Assemb Special leave with pay may be granted to Borough employees for jury duty, or those who are members of the National Guard, to attend annual encampment Application and approval procedure shall be the same as prescribed for regular leave with pay. Such special leave shall not be chargeable to the employees regular accrual. Pay during such periods of special leave shall be the regular rate less the amount(s) of pay received by the employee for National Guard duty during such period of encampment. The employee's regular rate of pay shall be exclusive of scheduled overtime pay. All employees applying for special leave to attend N - National Guard orders to the leave application. h All employees granted such special leave shall fur nish the Borough evidence as to the amount of National Guard pay received during the period of encampment. Such evidence may be in the form of a letter from the Commanding Officer of the Nation Guard unit. Leave benefits are not applicable to part -time or temporary employees. D. Holidays: The following Holidays shall be recogni ed by the Borough: New Year's Day, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Alaska Day, Veteran's Day, Thanksgiving Day and Christman Day. In the event of a recognized holiday falling on Saturday, the preceding Friday shall be observed. In the event of a recognized holiday falling on Sunday, the following Monday shall be observed. All employees shall be excused from work on recognized holidays,and special holi- days declared by the President of the United State or the Governor of the State of Alaska, except where the activities of the Borough require that regular or emergency work be performed. In the event holiday work is required, the rate of pay for employees working on hilidays shall be two times the regular rate of pay. E. Additional Benefits: The Borough shall pay one - half of the cost of Blue Cross or other similar hospitalization plan. Y - 1 1 Section 5. ATT F. Employment Terminations: 1. Employment may be terminated when ability to perform required duties falls below required standards, or for inefficiency, insubordinate habitual tardiness, use of intoxicating beverage on duty, or other just cause. 2. Except in an aggravating case where the best interests of the Borough will not be served, two weeks notice of termination will be given. 3. An employee resigning his or her position shal give at least two weeks notice to enable the Borough to make proper provision for filling the position. This requirement may be waived under extenuating circumstances, such as an immediate need for medical treatment, change o residence caused by unexpected military orders of the spouse, and similar circumstances. G. Other Employment: No regular employee of the Boro gt shall engage in any occupation or outside activity which is incompatible with his employment by the Borough, or adversely affects the performace of his or her municipal duties as may be determined by the Borough A. Annual Review: The general terms and conditions o employment of all employees of the Borough may be reviewed annually by the Borough Chairman and Borough Assembly during April of each year. B. Effective Date: Any changes in either the pay rates or general terms and conditions of employmen as set forth during the review and incorporated the approved budget shall become effective on tI first day of the following fiscal year unless otherwise provided for. C. Overtime: Overtime pay shall be paid to all non - supervisory employees at the rate of time and one - half the regular rate. When overtime is necessary with the option to such employee of taking off compensatory time for such work instead of such pay if desired and on a mutually agreeable schedul for such time off.
