EMERGENCY ORDINANCE NUMBER 68-re -AC
AIN ORDINANCE CREATING A SERVICE AREA TO BE KNOWN AS
KODIAX- ISLAND WATER SERVICE AREA NUMBER ONE FOR THE PURPOSE OF
PROVIDING WATER SERVICE WITHIN THAT AREA.
WHEREAS, Section 07.15.050 empowers the borough to
create service areas and to provide special services and
WHEREAS, the Kodiak Island Borough has received
petitions from numerous property owners living outside the
boundaries of the City of Kodiak requesting the formation of
a water service district.
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough that:
Section One: A service area to be known as the
Kodiak Island Borough Water Service District Number One be and
the same is hereby established to provide water service for the
area lying and being within the boundaries of the Kodiak Island
Borough outside the city limits of the City of Kodiak and more
particularly described as follows:
US Survey number 3466, 3104,
Shafka Acre Subdivision; Holland Acres
E, G, H, I, J, K, M, N, P of US Survey
unsubdivided portion of US Survey 3218
Bay and Island Lake Roads.
Section Two: It is hereby declared that a public emer-
gency affecting life, health, welfare, and property exists in the
above described area in that said area was previously served with
water by the City of Kodiak but that since the recent annexation
election held on question of annexation to the City of Kodiak
was defeated, the City of Kodiak has indicated that it will no
longer provide water service for areas outside the city and it
has previously been determined that the only sources of supply fo
domestic water purposes in the above described areas are grossly
contaminated and not fit for human consumption and therefore an
alternate source of supply must be provided.

Section Three, Services: KIB Water Service District
Number One is hereby established to provide water service includ-
ing installation, servicing, administration and collection costs
of the same for the area within its boundaries in the manner pro-
vided by law for local assessment districts or otherwise.
Section Four, Management: Kodiak Island Borough Water
District Number One shall be managed and operated by the Borough
Chairman and Assembly in the same manner as other Borough function:
Section Five, Costs: During the interim period and
prior to the establishment of said area as an Assessment District,
the cost of providing water services, installation, administra-
tion and collection whether such service is provided by the
Borough itself or by contract shall be a sum determined by
dividing the total cost of such service (exclusive of installation
which shall be on an assessment basis as provide•
for local assessments) by the number of parcels of property being
benefited by such service, to arrive a a "per property cost"
which sum shall be prorated on a twelve month basis, and
one - twelfth thereof assessible against each benefitted parcel o-
tract per month until such a time as a permanent ordinance has
been adopted and passed and is in effect, as to rates or
assessments, it being

Section Six: The Borough Chairman is hereby authorized

this area and the cost of the same, and also to investigate the
possibilities of contracting for this service with the City of

Kodiak and the cost of the same and report his findings to the
Borough Assembly before the permanent Ordinance establishing
KIB Water District Number One is adopted.
