ORDINANCE CREATING A SERVICE AREA TO BE KNOWN AS
`BOROUGH FIRE PROTECTION DISTRICT NUMBER ONE FOR
THE MOP' PROVIDING FIRE PROTECTION WITHIN THE SERVICE AREA.
WHEREAS, Section 07.15.050 empowers the borough to
create service areas to provide special services and
WHEREAS, the Kodiak Island Borough has received
petitions from numerous property owners living outside the

boundaries of the City of Kodiak requesting the formation of
a fire protection district
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough that

more or less.
Section Two, Services: Kodiak Island Borough Fire Protection
District Number One is hereby established to provide fire protection including
achninistration and collection costs of the same for the area within its
boundaries.
Section Three, Management: Kodiak Island Borough Fire Protection
and assembly in the same manner as other borough functions.
Section Four, The Costs: The cost of providing fire protection
including administration and collection of any assessments in connection
therewith provided by the Kodiak Island Borough whether such protection is
provided either by the Kodiak Island Borough itself or by contract shall be
a mill levy determined by dividing the total cost of the fire protection
provided, including its administration and collection of the assessments
therefore, by the total assessed value of personal and real property lying
within the fire protection district which shall be prorated on a twelve month
basis and one - twelfth thereof assessible against each such parcel or tract
of property per month until such a time as a permanent ordinance has been
adopted and passed and is in effect, it being the intention by this provision
that the cost of providing the service

is to be born by the property specially benefitted thereby and
the cost of providing interim service until the first of the
year shall bedone on a prorated basis for the rest of the
calendar year ending December 31, 1968, with each parcel or
tract of land being assessed its share for the remainder of the
calendar year, but which assessment shall be made and collected
with the 1969 taxes on such property.
Section Five: The borough chairman is hereby authorize
to investigate the feasibility of the borough providing the
services of fire protection for this area and the cost of the
same and also to investigate the possibilities of contracting
this service with the City of Kodiak and the cost of the same
and report his findings to the Borough Assembly before the
permanent ordinance establishing Kodiak Island Borough Fire
Protection District Number One is adopted .
Section Six: The Kodiak Island Borough Assembly
hereby finds that an emergency exists in that the area above
described has previously been receiving fire protection from the
City of Kodiak but due to the recent annexation election
affecting the above described area which failed there is reason
to believe that the fire protection will no longer be forthcoming
for this area that a public emergency affecting life, health,
welfare, and property from damage by fire exists and therefore
this ordinance shall go into effect if adopted by the affirma-
tive vote of all assembly members present at the meeting at
which it is introduced and read or the affirmative vote of
three- fourths of those elected at such meeting and shall remain
in force and effect for a period of sixty days.
