1968-16 Amending the Zoning Map Miller Point SubdivisionKODIAK ISLAND BOROUGH ORDINANCE NUMBER 68 -16 -0 AN ORDINANCE AMENDING THE ZONING MAP OF THE KODIAK ISLAND BOROUGH BY DESIGNATING TRACTS A, B, and LOT SEVEN (7), BLOCK SEVEN (7), OF THE ORIGINAL MILLER POINT, ALASKA, SUBDIVISION; TRACT A and B OF THE FIRST ADDITION TO THE MILLER POINT, ALASKA, SUBDIVISION; LOTS ONE (1) and TWO (2), BLOCK ONE (1), SECOND ADDITI•N TO MILLER POINT, ALASKA, SUBDIVISION; CHINIAK SCHOOL SITE and LOT SEVEN (7), BLOCK TWO (2); LOTS FOUR (4) THROUGH SEVEN (7), BLOCK FOUR (4) and LOTS FIVE (5) and SIX (6), BLOCK FIVE (5), OF THE MONASHKA BAY, ALASKA, SUBDIVISION FOR PUBLIC USE. WHEREAS, AS 07.15.340 empowers the Borough to enact a zoning ordinance and provide for its administration, enforcement and amendment, and WHEREAS, the Kodiak Island Borough has, pursuant thereto adopted Chapter Five of its Code of Ordinances and Resolutions, which provides for planning and zoning provisions and procedures, and WHEREAS, according to the Comprehensive Planning and Zoning Map of the Kodiak Island Borough adopted by the Borough Assembly, Tract A and Lot Seven (7), Block Seven (7) of the Origina Miller Point, Alaska, Subdivision, and Tracts A and B of the First Addition to the Miller Point, Alaska, Subdivision, and Lot Seven (7), Block Two (2), Lots Four (4) through Seven (7), Block Four (4) Page One, ORDINANCE NUMBER 68 - 16 - and Lote Five (5) and Six (6), Block Five (5), Monashka Bay, Alaska, Subdivision, are all presently classified as unclassified, and Tract B, Original Miller Point, Alaska, Subdivision and the Chinia School Site are presently classified as conservation, and Lots One (1) and Two (2), Block One (1), Second Addition to Miller Point, Alaska, Subdivision is now classified R -2, and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Zoning Map be changed to show all of the above- described tracts and parce of land to have been designated for public use, and it having been determined that the public necessity, convenience, general welfare and good zoning practice requires said redesignation, NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of the Kodiak Island Borough that Tracts A, B, and Lot Seven (7) Block Seven (7), of the Original Miller Point, Alaska, Subdivision; Tracts A and B, First Addition to Miller Point, Alaska, Subdivisio Lots One (1) and Two (2), Block One (1), Second Addition to Miller Point, Alaska, Subdivision; Chiniak School Site; Lot Seven (7), Block Two (2), Lots Four (4) through Seven (7), Block Four (4), an Lots Five (5) and Six (6), Block Five (5), of the Monashka Bay, Alaska, Subdivision now shown as Unclassified, Conservation, or R -2, as above stated, on the Zoning Map of the Kodiak Island Borough, be and the same are hereby redesignated for public use and said change be reflected on the official Zoning Map of the Kodiak Island Borough, and notice of this ordinance be given by publication in the "Kodiak Mirror" seven (7) days prior to the second reading of this ordinance, and that a public hearing be held thereon on the date of the second reading, and that this ordinance shall become effective at the expiration of thirty (30) days after the date of its adoption.
