AN ORDINANCE AMENDING THE KODIAK ISLAND BOROUGH CODE OF
ORDINANCES AND RESOLUTIONS BY ADDING THERETO CHAPTER SEVEN (7)
ADOPTING PORTIONS OF THE ALASKA ADMINISTRATIVE CODE PERTAINING TO
WATER SUPPLIES AND WASTE DISPOSAL
WHEREAS, at a Special Borough Election held on May 24,
1966, the duly qualified electors of the. Kodiak Island Borough
voted in favor of granting an additional area -wide power to the
Kodiak Island Borough authorizing the Borough to construct, maintai
and operate a hospita nd enter into the health and sanitation
field and
WHERE ' , ere ex7�sts a definite problem of sub- standard
water supply and sewage sposal systems in areas outside the city
limits of the City of Kod now therefore
BE IT ORDAI ction 1: That the Kodiak Island
Borough Code of Ordinances d Re olutions is hereby amended by
adding thereto Chapter Seven opting the rules and regulations
contained in the Alaska Admin' ve Code as follows:
Chapter Seven - Heal and Sanitation
Section One. The rulesnd re ulations contained in the
Alaska Administrative Code, Volume 2,eo7, Chapter 2, Sub -Chapt :
1 and 2, Sections 230 through 271 and \ 00 -% Nigh 333 pertaining to
sanitation and engineering of water supply systemsland waste dis-
posal are hereby adopted for use in the Borought the following
changes:
Section Two. All references ther ='n to e Commissioner
of Health and Welfare, Department of Health and Welfare or Health
Officer shall mean and refer to the Kodiak Island Borough Sanitariai
and his office or department.

Section Three. The penalty sections, Sections 271 and
333 shall be changed to read as follows:
Penalty:
Any person, firm or corporation violating any of
the provisions of this Code or these regulations
shall upon being found guilty, be subject to a
fine of not more than $300.00 or imprisonment for
not more than 30 days or both fined and imprisonment,
and each day that such person, firm or corporation
continues such violation shall be deemed a separate
offense.
Section Four. Severability.
In the event any portion, section, sub- section, sentence
clause or phrase of this Ordinance or the Code, rules or regulation
adopted hereby are for any reason held to be invalid or unconstitu-
tional by the decision of any court of competent jurisdiction,
such decision shall not effect the validity of the remaining portio s
of this Ordinance.
This ordinance shall become effective thirty (30) days
after its adoption and at least three (3) copies of the Code adopte'
hereby shall be filed in the office of the Borough Clerk and kept
available for public use, inspection and examination for a period
of fifteen (15) days before the adoption of this Ordinance and
after its adoption, the copies of the code shall be kept available
for public use, inspection and examination so long as the code
remains in force.
