1968-07 Rezoning Erskine Subdivision - FAILEDAN ORDINANCE REZONING LOTS FORTY -SIX (46) THROUGH FIFTY -TWO (52) AND FIFTY -SIX (56) THROUGH FIFTY -EIGHT (58) OF BLOCK SEVEN (7); LOTS FIFTY -NINE (59) THROUGH SIXTY -TWO (62) AND SIXTY -FIVE (65) THROUGH SIXTY -SEVEN (67) BLOCK EIGHT (8) and LOTS ONE HUNDRED THREE (103) THROUGH ONE HUNDRED FIFTEEN (115) BLOCK NINE (9) ALL OF THE ERSKINE SUBDIVISION TO THE CITY OF KODIAK BEING A PART OF U.S. SURVEY NO. 562 FROM R -2 TO R -3 WHEREAS, AS 07.15.340 empowers the Borough to enact a zoning ordinance and provide for its administration, enforcement and amendment, and WHEREAS, the Kodiak Island Borough has pursuant thereto adopted Chapter 5 of its C of Ordinances and Resolutio which provides for planning and/ oning provisions and procedure, and, I WHEREAS, according to;the comprehensive plan adopted by thj\odiak / Island Borough, Loti Forty -s 6) through Fifty - two (52) and Fifty -six (56) through Fift eight/ (58) of Block Seven (7) ; ;Lots Fifty-nine (59) through S' two (6 and Sixty -five (65) tbfrough\Sixty -seven (67) Block Eight( ; and Lots One hundred , (103) through One hundred fteen `(115 ) Block Nine (9) of the Erne /,Subdivision of U.S. Survey 562 have been classified as R -2 mid — WHEREAS, DON SLATER, FITZGERALD, R. C. WILSON, JOHN TUSVIK, CLINTON F. CROW, J MANN AND VICTOR AND DOTTIE WILLIAMS have p itioned the Kodiak Island Borough Planning and Zoning Comm'- sion \to reclassify said lots from R -2 to R -3 and pursuant thereto the ` dak Island Borou•h Planning and Zoning Commission held a public heaFing.n said petition and thereafter recommended against t rezonin of said lots and Page One, ORDINANCE NO. 68 -7 -0 KODIAK ISLAND BOROUGH ORDINANCE NUMBER 68 -7 -0 N, JOAN MANN AND ANITA AREAS, the Kodiak Island Borough Assembly having considered this matter and having determined that it is in the best interest of all parties concerned that another public hearin be held and all persons interested be heard on the question of whether or not the above - described lots should be reclassified from R -2 to R -3 in order that the Kodiak Island Borough Assembly may determine whether the public necessity, convenience, general welfare and good zoning practice requires said classification, NOW, THEREFORE, BE IT ORDAINED by the Borough Assembl of the Kodiak Island Borough that Lots Forty -six (46) through Fifty -two (52) and Lots Fifty -six (56) through Fifty -eight (58) of Block Seven (7); Lots Fifty -nine (59) through Sixty -two (62) and Lots Sixty -five (65) through Sixty -seven (67) of Block Eight (8); and Lots One hundred three (103) through One hundred fifteen (115) of Block Nine (9) of the Erskine Subdivision of U.S. Survey 562 now classified as R -2 be and the same are hereby reclassified as R -3 and that notice of this Ordinance be given by publication in the Kodiak Mirror seven (7) days prior to the second reading of this Ordinance and that a public hearing be held thereof on the data of the second reading of this Ordinance and that this Ordinance become effective at the expiration of thirty (30) days after its adoption.
