FY1967-6 Zoning Ordinance for Baranof Heights Subdivision U.S. Survey 13961
WHEREAS, Section 07.15.340, Alaska Statutes, empowers the Borough to enact
a zoning ordinance and provide for its administration, enforcement and amendment; and,
WHEREAS, Section 24 Sub-Chapter 2 of Chapter 5 of the Kodiak Island
Borough Code of Ordinances and Resolutions provides that the BOROUGH ASSEaBLY may
by ordinance amend, supplement, modify, repeal or otherwise change the zoning regula-
tions and boundaries of districts, and,
WHEREAS, according to the caaprehensive plan adopted by the KODIAK ISLAND
BOROUGH, Lots Ten (10) through Nineteen (19) of Block Pbur (4), Lots One (1) through
Fifteen (15) of Block Eleven (11) , Lots Twelve (12) through Twenty TWo (22) of
Block Six (6), Lots Ten (10) thorough Nineteen (19) of Block Seven (7), Lots One (1)
through Eleven (11) of Block Eight (8), Lots One (1) through Fourteen (14) of Block
Nine (9), and Lots One (1) and Two (2) of Block Ten (10), all as shown on the
preliminary

classified as Unclassified, and
WHEREAS, the KODIAK ISLAND BOROUGH has been petitioned by BARANWHEIGHTS,
INCORPORATED for a reclassification of Lots Ten (10) through Nineteen (19) of
Block Four (4) and Lots One (1) through Fifteen (15) of Block Eleven (11), all as
shown on the preliminary plat of the Baranof Heights Subdivision of U.S. Survey
NO. 1396 dated January 18, 1965 and revised January 31, 1967, from Unclassified to
R,3: and Late TWe1ve (12) thno401Twenty4Wa of Block Six (0), Lots Ten - (10 ) through
Nineteen (19) of Block Seven (7) Lots One (1) through Eleven (11) of Block Eight (8),
Lots One (1) through Fourteen (14) of Block Nine (9), and Lots One (1) and Two (2)
of Block Ten (10), all as shown on the preliminary plat of the Baranof Heights
Subdivision of U.S. Survey No. 1396 dated January 18, 1965, and revised January 31,
1967, from Unclassified to R 2, and the KODIAK ISLAND BOROUGH has considered this
petition,
NOW, THEREFORE, BE IT ORDAINED by the BOROUGH ASSEMBLY of the KODIAK ISLAND
BOi that Lots Ten (10) through Nineteen (19) of Block Four (4) and Lots One (1)
through Fifteen (15) of Block Eleven (11), all as shown on the preliminary plat of •
of the Baranof Heights Subdivision of U.S. Survey No..1396 dated January 18, 1965,
and revised January 31, 1967, now classified as Unnclassified, be and the same are
hereby reclassified as R-3; and Lots Twelve (12) thorough Twenty -Two (22) of Block
Six (6), Lots Ten (10) through Nineteen (19) of Block Seven (7), Lots One (1)
through Eleven (11) of Block Eight (8), Lots One (1) through Fourteen (14) of Biock
Nine (9), and Lots One (1) and Two (2) of Biock Ten (10), all as shown on the
preliminary plat of the Baranof Heights Subdivision of U.S. Survey No. 1396 dated
January 18, 1965, and revised January 31, 1967, now classified as Unclassified, be
and the same are hereby reclassified as R -2, and that notice of the ordinance be
given by publication in the Kodiak Mirror seven (7) days prior to the second reading
of this ordinance and that a public hearing be held thereon on the date of the
second reading and that publication of this ordinance be made by posting a copy
hereof on the Borough Assembly Bulletin Board far a period of ten (10) days
following its passage and approval and publishing a resume hereof in the Kodiak
Mirror, together with a notice of public hearing thereon and mailing a copy of the
same to the Kodiak Mirror.
