FY1967-5 Amending Chapter 5, Subchapter 2, Adding New Section Service Recreational UseKODIAK ISLAND BOROUGH ORDINANCE NUMBER 67- 4 - O AN ORDINANCE OF THE KODIAK ISLAND BOROUGH AMENDING THE PERMITTED USES IN RESIDENTIAL ZONES AND AMENDING THE OFF- STREET PARKING REQUIREMENTS FOR CHURCHES, CLINICS AND OTHER PROFESSIONAL OFFICES. BE IT ORDAINED by the Borough Assembly of the Kodiak Island Borough as follows: Section One: Chapter Five (5), Subchapter Two (2), Section Five (5), is amended to read as follows: "Section 5. Residential (R zones): A. Residential zones shall be of the three types as follows: 1. R -1, limited to one - family dwellings, and the following uses permitted: a. Truck gardening, the raising of bush and tree crops, flower gardening, and the use of greenhouses. b. Accessory buildings and uses not used or operated for gain and not including guest houses or accessory living quarters. c. Required off - street parking. d. Home occupations as follows: (1) Baby sitting - limited to 5 children other than immediate family (2) General dealerships and limited sales - limited to those which can be carried out by the occupant only, with no employees. (3) Small appliance and watch repair - limited to repair of appliances less than one cubic foot in size and tothose repairs which can be performed by the occupant only, with no employees (4) Other uses or services similar to the uses herein listed in the type of service or goods sold, in the number of persons employed, in the number and types of vehicles attracted to th premises and in the effect upon adjacent areas, as determined by the Boragh Planning & Zoning Commission after proper notice and public hearing. e. Churches, provided that no part of any building be located nearer than 30 feet to any adjoining lot or street line and that one public off - street par ing space for each 4 seats be provided based on maximum seating capacity. f. Parks and playgrounds. g. Schools, provided that no part of any building be located nearer than 30 feet to any adjoining bt or street line. h. Hospitals, provided that no part of any building be located nearer than 30 feet to any adjoining lot or street line. 2. R -2, limited to one and two- family dwellings and the following uses permitted: a. All uses permitted under R -1. b. Clinics and professional offices, provided that Page One, ORDINANCE NO. 67- �"" Q one off - street parking space for each 250 square feet of floor area, but not less than 5 parking spaces, be provided. 3. R -3, with the permitted uses as follows: a. One - family, two - family and multiple family dwellings. b. Boarding Houses c. All uses permitted under R -1 and R -2." Section Two: Chapter Five (5), Subchapter Two (2), Section Fifteen (15). A. 1. (b) (2), is amended to read as follows: "(2) General auditorium, high school or college auditorium, stadium, theater, meeting hall or eating and drinking establishment - one (1) public parking space for each 5 seats based on maximum seati capacity." Section Three: Chapter Five (5), Subchapter Two (2), (15). A. 1. (b) is amended by adding the following: " (16) Churches - one public off - street parking place for each four (4) seats based on maximum seating capacity. (17) Clinics and professional offices - one (1) off - street parking place for each 250 square feet of floor area, but not less than five (5) parking spaces. " Section Four: This Ordinance shall be in full force and effect from and after its passage and approval as required by law. First Reading and Approval Date: February 16, 1967.
