FY1967-3 Amending Chapter 6 Adding Section 3.1 Exchange of Borough LandsKODIAK ISLAND BOROUGH ORDINANCE NUMBER 67 -3 - AN ORDINANCE AMENDING CHAPTER 6 OF THE BOROUGH CODE OF ORDINANCES BY AMENDING SECTION 1 THEREOF AND ADDING SECTION 3.1 THERETO TO PROVIDE KR THE EXCHANGE OF BOROUGH LANDS BE IT ORDAINED: Section 1 of Chapter 6 of the Borough Code of Ordinances is hereby amended to read as follows: "Section 1. Lands available: All lands lying and being within the limits of the Borough to which the Borough holds title or which it has selected and which in the opinion of the Borough Assembly are not needed for or devoted to a public use, may be leased, sold, or exchanged as hereinafter provided, but only in such cases where it is clearly demonstrated that such sale, lease or exchange would be in the best interests of the public." Chapter 6 of the Borough Code of Ordinances is further amended by adding Section 3.1 thereto, which shall read as follows: "Section 3.1. Borough lands not needed for or devoted to a public use may be exchanged by the Borough Assembly forother Lands of like area or value owned by the State of Alaska, the Unite States, or any of its federal agencies or any political subdivisio s of the state; the cities within the Borough boundaries and persons, associations or corporations where it is clearly demonstrated that such exchange is in the best interests of the public. Before such an exchange is effected the Borough Assembly shall first adopt a resolution setting forth a description of the property owned by the Borough intended to be exchanged, the fact that it is not need ed for or used or devoted to a public use, a description of the la for which the Borough land is proposed to be exchanged, and the fact that such an exchange is in the best interests of the pblic." Chapter 6 is further amended by the Amendment of Section 12 thereto to read as follows: "Section 12. Appraisal: No borough lands shall be leased, sold, exchanged, or a renewal eeissueunless the same same been appraised within 90 days prior of the term of the sale, lease, exchange or renewal lease. Appraisals shall reflect the number and value of borough services rendered to the land in question, its location, and other facts affecting its desirability. Similarly, the Borough Assessor shall appraise any lands in like the fg p take in exchange for boroug h purposes." This ordinance shall become effective thirty (30) days after its adoption.
