KODIAK ISLAND BOROUGH
ORDINANCE NUMBER 66 -24-0
WHEREAS, Section 07.15.340, Alaska Statutes, empowers the Borough to enact a
zoning ordinance and provide for its administration, enforcement and amendment;
and,
WHEREAS, Section 24, Sub - Chapter 2 of Chapter 5 of the Kodiak Island Borough
Code of Ordinances and Resolutions provides that the BOROUGH ASSEMBLY may by
ordinance amend, supplement, modify, repeal or otherwise change the zoning regula-
tions and boundaries of districts, and,
WHEREAS, according to the comprehensive plan adopted by the KODIAK ISLAND
BOROUGH, Lots One (1), Two (2), Three (3), Four (4), Five (5), and Six (6) of
Block One (1); Lots One (1), Two (2), Three (3), Four (4), and Five (5) of Block
Two (2); and Lots Eight (8), Nine (9), Ten (10), Eleven (11), Twelve (12), Thirteen
(13), and Fourteen (14) of Block Three (3), all within U.S. Survey No. 1396 and part
of the proposed Addition No. Two (2) to the Baranof heights Subdivision, have been
zoned and are now classified as Unclassified, and
WHEREAS, the KODIAK ISLAND BOROUGH has been petitioned by BARANOF HEIGHTS,
INCORPORATED, for a reclassification of Lots One (1), Two (2), Three (3), Four
(4), Five (5), and Six (6) of Biock One (1); Lots One (1), Two (2), Three (3),
Four (4), and Five (5) of Block Two (2); and Lots Eight (8), Nine (9), Ten (10),
Eleven (11), Twelve (12), Thirteen (13), and Fourteen (14) of Block Three (3),
all within U.S. Survey No. 1396 and part of the proposed Addition No. Two (2) to
the Baranof Heights Subdivision, from Unclassified to R -3, and the KODIAK ISLAND
BOROUGH has considered this petition,
NOW, THEREFORE, BE IT ORDAINED by the BOROUGH ASSEMBLY of the KODIAK ISLAND
BOROUGH that Lots One (1), Two (2), Three (3), Four (4), Five (5), and Six (6)
of Block Cne (1); Lots Ons (1), Two (2), Three (3), Four (4), and Five (5) of
Biock Two (2); and Lots Eight (8), Nine (9), Ten (10), Eleven (11), Twelve (12),
Thirteen (13), and Fourteen (14) of Block Three (3), all within U.S. Survey No.
1396 and part of the proposed Addition No. Two (2) to the Baranof Heights Subdivi-
sion, now classified as Unclassified, be and the same are hereby reclassified as
R -3, and that notice of this ordinance be given by publication in the Kodiak Mirror
.eves (7) days prior to the second reading of this ordinance and that a public
hearing be held thereon on the date of the second reading and that publication of
this ordinance be made by posting a copy hereof on the Borough Assembly Bulletin
Board for a period of ten (10) days following its passage and approval and publish-
ing a resume hereof in the Kodiak Mirror, together with a notice of public hearing
thereon and mailing a copy of the same to the Kodiak Mirror.
