FY1966-23 Zoning Ordinance for Baranof Heights SubdivisionWHEREAS, Section 07.15.340, Alaska Statutes, empowers the Borough to
enact a zoning ordinance and provide for its administration, enforcement and
Amendment; and,
WHEREAS, Section 23 of Ordinance No. 64 -5 provides that the BOROUGH
ASSEMBLY may by ordinance amend, supplement, modify, repeal or otherwise change
- the zoning regulations and boundaries of districts, and,
WHEREAS, according to the comprehensive plan adopted by the KODIAi
ISLAND BOROUGH, Lots Six (6), Seven (7), and Eight (8) of Block Four (4), and
Lots Four (4), Five (5), Six (6), Seven (7), Eight (8), Nine (9), and Ten (10)
of Block Five (5), all of the Baranof Heights Subdivision of U.S. Survey No.
1396, have been zoned and are now classified as R -2, and
WHEREAS, the KODIAK ISLAND BOROUGH has been petitioned by Baranof
Heights, Inc. for a reclassification of Lots Six (6), Seven (7), and Eight (8)
of Block Four (4), and Lots Four (4), Five (5), Six (6), Seven (7), Eight (8),
Nine (9), and Ten (10) of Block Five (5), all of the Baranof Heights Subdivision
of U.S. Survey No. 1396, and, said Petition has been considered by the BOROUGH
ASSEMBLY, and public hearing held thereon on the Third day of November, 1966,
and the petitioner having requested that his petition be amended to include only
Lots Four (4), Five (5), Six (6), and Seven (7) of Block Five (5) of the
Baranof Heights Subdivision, and said amended petition has been considered by
the Borough Assembly and public hearing held thereon on the Seventeenth day of
November, 1966,
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of the KODIAK
ISLAND BOROUGH that Lots Four (4), Five (5), Six (6) and Seven (7) of Block Five
(5), of the Baranof Heights Subdivision of U.S. Survey No. 1396, now classified
as R -2, be and the same are hereby reclassified as R -3, and that publication of
this ordinance be made by posting a copy hereof on the Borough Assembly bulletin
A board for a period of ten (10) days following its passage and approval and
publishing a resume hereof in the Kodiak Mirror, together with the Notice of
Public Hearing thereon and mailing a copy of the same to the Kodiak Mirror.

Second Reading, Public Hearing and Passage Date: November 17, 1966
