ORDINANCE NO. 66 -22 -0
AN ORDINANCE PROVIDING FOR THE ADOPTION OF A CODE CP ORDINANCES AND
RESOLUTIONS OF ALL GENERAL ORDINANCES AND RESOLUTIONS HAVING THE
FORCE AND EFFECT OF LAW.
WHEREAS, AS 07.20.160 requires that the Kodiak Island Borough within
three (3) years after its incorporation shall cause to be prepared a general
codification of all Ordinances and Resolutions having the force and effect of law.
NOW, THEREFORE, Ea it ordained by the Borough Assembly of the Kodiak
Island Borough as follows:
1. That the bulk formal revision of general Borough Ordinances and
Resolutions known as the CODE OF ORDINANCES AND RESOLUTIONS,
Kodiak Island Borough, Alaska, is adopted and enacted as the
general and permanent law of the Kodiak Island Borough.
2. The following Ordinances and Resolutions are hereby repealed:
Ordinance 64 -1, Ordix:.cnce 64 -2, Ordinance 64 -4, Ordinance 64 -5,
Ordinance 64 -6, Ordinance 65 -Z, Ordinance 65 -3, Ordinance 65 -4,
Ordinance 66 -1, Ordinance 66 -16 -0, Ordinance 66 -20 -0, Resolution
65 -6, Resolution 65 -7, Resolution 65 -33, and Resolution 66-27.
3. Nothing contained in the Code of Ordinances and Resolutions,
Kodiak Island Borough, Alaska, and nothing contained in Section
two (2) shall be interprzted or construed as a repeal or modifi-
cation of
(a) A special, local or temporary Ordinance or'::_soiution,
(b) An Ordinance or Resolution making an appropriation or affect-
ing a bond issue or by which a bond issue may have been author-
ized.
(c) a tax, fee, assessment, or other charge occurred or imposed,
(d) an Ordinance or Resolution authorizing, ratifying, confirming,
approving or accepting a compact or contract with another
political body.
4. The repeal provided for in Section two(2) hereof shall not effect
any offense or at committed or done or any penalty or forfeiture
incurred or any contract or right established or occuring before
the effective date of the Ordinance, nor shall such repeal affect
any Ordinance dedicating, naming, establishing, locating, relocating
vacating, etc. any street or public way in the Borough; nor shall
such repeal affect any rights, duties, or obligations under any
zoning Ordinance or any Amendment to any zoning map on file in the
office of the Borough Clerk.
5. Any and all additions or amendments to such code, when passed in
such form as to indicate the intention of the Borough Assembly to
make the same a part thereof, shall deem to be incorporated in
such code so that reference to the Code of Ordinances and Resolutions,
Kodiak Island Borough, Alaska, shall be understood and intended to
include such additions and amendments.
6, A copy of said code shall be kept on file in the office of the Bor-
ough Clerk, preserved in loose leaf form, or in such other form as
the Borough Clerk may consider most expedient. Copies of said code
shall be available for purchase by the public at a charge of $5.00.
Publication of this ordinance shall be made by posting a copy hereof on
the Borough Assembly bulletin board for a period of ten (10) days following passage
and approval.
