FY1966-11 Zoning Ordinance for Erskine SubdivisionKODIAK ISLAND BOROUGH AMENDED ORDThNCE NUMBER 66 -11 -0 WHEREAS, Section 07.15.340, Alaska Statutes, empowers the Borough to enact a zoning ordinance and provide for its admin- istration, entrcement and emendment, and, WHEREAS, the KODIAK ISLAND BOROUGH has pursuant thereto adopted Ordinance No. 64 -5, and WHEREAS, Section 23 of Ordinance No. 64 -5 provides that the Borough Assembly may by ordinance amend, supplement, modify, repeal or otherwise change the zoning regulations and boundaries of districts, and, WHEREAS, according to the comprehensive plan adopted by the KODIAK ISLAND BOROUGH, Lots Eighty-nine (89), Ninety (90), Ninety -one (91), Ninety -two (92), One- hundred - fifteen (115), One - hundred- sixteen (116), and One- hundred - seventeen (117) of Block Nine (9), all located within the Erskine Subdivision of U.S. Survey No. 562, recorded February 17, 1950, in Book R, page 348, of the Kodiak Recording Precinct, Third Juducial District, State of Alaska, have been zoned and are now classified as R -2, and, WHEREAS, the KODIAK ISLAND BOROUGH has been petitioned by ELAINE BANKS and PAUL T. WALLS, for a reclassification of Lots Eighty -nine (89), Ninety (90), Ninety -one (91), Ninety -two (92), One- hundred- fifteen (115), One- hundred - sixteen (116), and One - hundred- seventeen (117) of Block Nine (9), all located within the Erskine Subdivision of U.S. Survey No.562, recorded February 17, 1950, in Book R, page 348, of the Kodiak Recording Precinct, Third Judicial District, State of Alaska, from R -2 to business, and, said petition has been considered by the BOROUGH ASSEMBLY and public hearing heldthereon on the 19th day of May, 1966, and the Petitioner having requested that his Petition be amended to Page One, AMENDED.ORDINANCE NUMBER 66 -11 -0 exclude Lot One- hundred - fifteen (115), Block Nine (9). NOW, THEREFORE, BE IT ORDAINED by the BOROUGH ASSEMBLY of the KODIAK ISLAND BOROUGH, that Lots Eighty -nine (89), Ninety (90), Ninety -one (91), Ninety -two (92), One- hundred - sixteen (116) and One- hundred - seventeen (117) of Block Nine (9), all located within the Erskine Subdivision of U.S. Survey No. 562, reprded February 17, 1950, in Book R, page 348, of the Kodiak Recording Precinct, Third Judicial District, State of Alaska, now classified as R -2, be and the same are hereby reclassified as business and that publication of this ordinance be made by posting a copy hereof on the Borough Assembly bulletin board for a period of ten (10) days following its passage and approval and publishing a resume' hereof in the Kodiak Mirror, and mailing a copy of then_ e to the Kodiak Mirror. / First Reading and Approval Date: b nct S� C Second Reading, Public Hearing and P ssage Date, as amended: /Y)� /1 J Q 4 6 PASSED AND APPROVED by the KODIAK ISLAND BOROUGH ASSEMBLY on the 19th day of May, 1966.
