FY1966-7 Zoning Ordinance for Kodiak TownsiteWHEREAS, Section 07.15.340, Alaska Statutes, empowers the
Borough to enact a zoning ordinance and provide for its administra-
tion, enforcement and amendment; and,
WHEREAS, the KODIAK ISLAND BOROUGH has pursuant thereto
adopted Ordinance No. 64 -5, and,
WHEREAS, Section 23 of Ordinance No. 64 -5 provides that
the BOROUGH ASSEMBLY may by ordinance amend, supplement, modify,
repeal or otherwise change the zoning regulations and boundaries
of districts, and,
WHEREAS, according to the comprehensive plan adopted by
the KODIAK ISLAND BOROUGH, LotsFifteen (15) and Seventeen (17) of
Block Sixteen (16) of the Kodiak Townsite are now classified as
R -3, and,
WHEREAS, the KODIAK ISLAND BOROUGH has been petitioned b3t
JOSEPH E. CARBIN and JAMES E. EGGEMEYER, for a reclassification o$
Lots Fifteen (15) and Seventeen (17) of Block Sixteen (16) of the !
Kodiak Townsite from R -3 to business, and,
WHEREAS, pursuant thereto the Planning and Zoning Commis- -
ion on the 7th day of February, 1966, at their regular meeting pal

passed a motion as follows:
"The P & Z Commission does find a need for an additional;
business area, and justified by good zoning practice
of following natural lot and block boundaries, ds
hereby recommend to the Borough Assembly the app
of rezoning those portions of Lot Five (
(5), Six (6),
), Four -
Seven (7), Eight (8), Twelve (12), Thirteen
teen (14), Fifteen (15), Sixteen (16), and Seventeen
(17) of Block Sixteen (16), Kodiak Townsite, now
classified as R -3, to business,
WHEREAS, THEREAFTER the KODIAK ISLAND BOROUGH approved
Ordinance Number 66 -7 -0 on March 3, 1966 for first reading, and,
WHEREAS, thereafter and on the 7th day of April, 1966
a public hearing was held on Ordinance Number 66 - - at which

tim,: 14T-was made, seconded and passed that the Ordinance
be rewritten to include only those lots presently cut in half
by different zoning which consists of Lots Fifteen (15) and
Seventeen (17) of Block Sixteen (1b) of the Kodiak Townsite.
NOW, THEREFORE, be it ordained by the BOROUGH ASSEMBLY
of the KODIAK ISLAND BOROUGH that that portion of Lots Fifteen
(15) and Seventeen (17) of Block Sixteen (16) of the Kodiak Town -
site now classified as R -3, be and the same as hereby classified
as business, and that notice of this Ordinance be given by publicat-
ion in the Kodiak Mirror one (1) week prior to the second reeding
of this Ordinance as rewritten, and that a public hearing be. held
thereon on the date of the second reading, and that publication of
this Ordinance as rewritten be made by posting a copy hereof on
the BOROUGH ASSEMBLY bulletin board for a period of ten (10) days ,
following its passage and approval, and publishing a resume' hereof
in the KODIAK MIRROR, together with the Notice of Bublic Hearing
thereon and mailing a copy of the same to the KODIAK MIRROR.
First Reading and Approval Date: April 21, 1966.
Second Reading, Public Hearing and Passage Date: 1ay
1966.
