FY1964-3 Establishing a Special Service DistrictKODIAK ISLAND BOROUGH Page One, ORDINANCE No. 64 -3 ORDINANCE NO. 64 -3 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH, KODIAK, ALASKA, PROVIDING FOR THE FORMATION OF A SPECIAL SERVICE DISTRICT, AUTHORIZING THE LEVYING OF TAXES AND ASSESSMENTS IN THE SERVICE AREA. BE IT ORDAINED BY THE BOROUGH ASSEMBLY OF THE KODIAK ISLAND BOROUGH AS FOLLOWS: WHEREAS, in the opinion of the Borough Assembly of the Kodiak Island Borough, due to the recent disaster certain water wells in the Mission Road area have gone dry or have been contamina- ted by salt water and there exists in the area affected, an emergency requiring action by this body which is essential to the health, safety and welfare of the people residing within the area bounded by and described as follows: The property lying and being adjacent to both shores of that body of water formerly known as Mission Lake, part of which lies within the boundaries of US Survey No. 1822 and extending on both sides of the Mission Road Extension from the southwest corner of Mission Lake to the terminus of Mission Road Extension at the Loran Station on Spruce Cape. WHEREAS, in the opinion of the Borough Assembly of the Kodiak Island Borough, a necessity exists requiring the establishment of a special service district to supply said area with water and that the property and real estate abutting and adjacent to the above described area will be especially benefitted thereby and the owners of the property lying within the said area will be fully compensated for the cost of said improvements in the enhancement of the values of the real estate and property af- fected by said improvement and the cost to said property owners in the opinion of the Borough Assembly will be equitable and just in prion to said increased values: THEREFORE, be it resolved by the Borough Assembly of the Kodiak Island Borough that improvement District No. 1 of the odiak Island Borough shall consist of and include the area known s all that property lying on both sides of Mission Lake and xtending north and east therefrom on both sides of Mission Road xtension to the terminus of Mission Road at the boundaries of he U. S. Coast Guard Loran Station located on Spruce Cape, inclu- ing all tracts lying and being within the Spruce Cape Small ract Group. BE IT FURTHER RESOLVED by the Borough Assembly of the odiak Island Borough that it is the opinion of the Borough As- embly that the cost of laying the pipeline along the main road f said area will be just to the property owners thereon and is arranted under the necessity which exists for said improvements nd that the cost of said improvements shall be paid as follows, o -wit: By Special Assessments to be levied against all proper - ies lying and being within said improvement District and benefit- ed thereby, which assessment shall be pro -rated over a period of ears, and whall be collected in an addition to any real property axes assessed, levied and collected in the said area, for school, orough, and other purposes. BE IT FURTHER RESOLVED that the plan adopted by the orough Assembly of the Kodiak Island Borough to be used for de- raying the expense of said improvement as applied to the property owners whose property is benefitted by said improvement shall be uch a rule of apportionment as shall effect a substantial equa- ity between said owners, considering the benefits received by Page Two, ORDINANCE No. 64 -3 BE IT FURTHER RESOLVED that the Special Improvement District be governed by the Borough Assembly of the KODIAK ISLAND BOROUGH.
