ORDINANCE NO. FY2019-13
AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AMENDING
KIBC TITLE 2 ADMINISTRATION AND PERSONNEL, CHAPTER 2.20 BOROUGH MAYOR,
SECTION 2.20.40 DUTIES TO ALTER THE PROCEDURE BY WHICH LETTERS ARE SIGNED
BY THE BOROUGH MAYOR.
WHEREAS, KIBC 2.20.040 requires the Borough Mayor to obtain authorization from the
Assembly for any written or electronic communication, or base such communication on a good
faith belief that the mayor is speaking on behalf of the assembly; and
WHEREAS, the Borough Assembly often receives requests for letters of support for various
causes: and
WHEREAS, the time sensitive nature of these requests oftentimes require the Mayor or
Assembly to call a special meeting in order to approve these letters in a timely manner; and
WHEREAS, these requests are frequently routine or administrative in nature.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is of a general and permanent nature and shall become a part of
the Kodiak Island Borough Code of Ordinances.
Section 2: That section 2.20.040 of the Kodiak Island Borough Code of Ordinances is
amended to read as follows:
2.20.040 Duties.
A. The mayor shall act as ceremonial head of the borough. The mayor shall preside at all
assembly meetings, and sign ordinances and ^'ho eF daGLI,;,ents resolutions on the borough's
behalf upon assembly authorization. The failure of the mayor to sign an ordinance or resolution
does not invalidate them.
B. The mayor is authorized to proclaim events, issue certificates of appreciation and sign letters
of support for various groups that are routine and administrative in nature. Requests for
endorsements and letters that are recommending policies of consequence to the borough a}ay

subsection shall not be interpreted as restricting the mayor's right to state his or her personal
opinion on any issue.
C. Members of boards, committees, and commissions, except for members of the board of
adjustment, members of the board of equalization, and elected service area board members, are
appointed by the mayor and confirmed by the assembly in accordance with KIBC 2.100.030.
Effective Date: This ordinance takes effect upon adoption. (Note: KIBC 2.30.070 states an
ordinance takes effect upon adoption or at a later date specified in the ordinance.)
