FY2018-16 Underground Storage Tank Replacement - 3 Schools (Main Elementary, Old Harbor School and Port Lions School) with Golden Alaska Excavating in an amount not to exceed $208,558.FY2018-I6 KODIAK ISLAND BOROUGH, ALASKA CONSTRUCTION CONTRACT 3 SCHOOLS UST REPLACEMENT #15011 PROJECT NAME AND NUMBER This CONTRACT ("Contract"), between the Kodiak Island Borough, Alaska, herein called the Borough, acting by and through its Borough Manager, and Golden Alaska Excavating, LLC, Company Name PO Box 8908. The Contractor, for and in consideration of the payment or payments herein specified and agreed to by the Borough, hereby covenants and agrees to furnish and deliver all the materials and to do and perform all the work and labor required in the construction of the obove-referenced project as bid by the Contractor, which bid and prices named, together with the Contract Documents (as hereinafter defined) are made a part of this Contract and accepted as such. It is distinctly understood and agreed that no claim for additional work or materials, done or furnished by the Contractor and not specifirally herein provided for, will be allowed by the Borough, nor shall lite Contractor do any work or famish any material not covered by this Contract, unless such work or materials is ordered in writing by the Borough. In no event shall the Borough be liable for any materials furnished or used, or for any work or labor done, unless the materials, work, or labor are required by the Contract or on written order furnished by the Borough. Any such work or materials which may be done or furnished by the Contractor without written order first being given shall be at the Contractor's own risk, cost, and expense and the Contractor hereby covenants and agrees to make no claim for compensation for work or materials done or furnished without such written order. Payment under this Contract shall not exceed Two Hundred Eiehl Thousand Five Hundred Fifty - Eight dollars ($208.558.00). The Contractor further covenants and agrees that all materials shall be furnished and delivered and all work and labor shall be done and performed, in every respect, to the satisfaction of the Borough, on or before: August 15.2018. It is expressly understood and agreed that in case of the failure on the part of the Contractor, for any reason, except with the written consent of the Borough, to complete the furnishing and delivery of materials and the doing and performance of the work before the aforesaid date, the Borough shall have die right to deduct from any money due or which may become due the Contractor, or if no money shall be due, the Borough shall have the right to recover Liquidated Damages as described in the Special Conditions for each calendar day elapsing between the time stipulated for achieving substantial completion of an individual phase and the actual date of completion of that phase in accordance with the terms hereof; such deduction to be made, or sum to be recovered, not as a penalty but as liquidated damages. Provided, however, that upon receipt of written notice from the Contractor of the existence of causes over which the Contractor has no control and which must delay furnishing of materials or the completion of the work, the Contracting Officer may, at his or her discretion, extend the period specified for the furnishing of materials or the completion of the work, and in such case the Contractor shall become liable for liquidated damages for delays commencing from the date on which the extended period expires. The bonds given by the Contractor in tic sum of S208,558.00 Payment Bond, and 5208,558.00 Performance Band, to secure the proper compliance with the terms and provisions of this Contract, arc submitted herewith and made a part hereor. The Contractor further covenants and agrees that The entire construction will be done under the administration of and to the complete satisfaction of the Borough subject to the inspection at all times and approval by any regulatory agency, and in accordance with the laws of the State of Alaska and the Borough. For purposes of this Contract, Contracting Officer means Michael Powers or any other person designated by the Borough Manager. The Contractor is an independent contractor and not an employee or agent of the Borough. During excavation it was discovered that the water line was over 15 feet deep. Return to Old Harbor to complete the demolition of the UST. June 22-24, 2018 Initial work conducted June 22-24. GA mobilized to OH the afternoon of June 22 on a charter flight. The flight was at max weight to accommodate personnel and only h materials & tools/supplies. A second charter was scheduled for Saturday mid-morning to fly out the remaining tools/supplies & compactor. Saturday morning GA crew located City of OH employee to pick up 50 gal tanks to pump left over fuel from the UST. Then crew mobilized rental equipment to job site. The crew excavated what they could around the GCI dish and found three corners of UST, which was 6'x12'. Top of tank was found 3' below existing grade. Pictures were sent to Matt. At this point GA was in standby mode until KIB could make decisions. The GCI dish was located over the top of the UST which caused a major obstruction. The crew did not see or smell any signs of contaminated soil in the areas they excavated, however the inspector needed to take samples. At this point the OH crew was on standby, and during this time we had an employee on standby at the airport in Kodiak with the rest of the tools/supplies & compactor to charter the second plane in the event GA was told to move forward with the project. The OH crew put plywood over the excavated holes for safety purposes, and was thought to leave the holes open for the soil inspector to fly down at another time to take soil tests. At this point GA crew was anticipating catching a charter back to Kodiak Saturday evening. GA then got the instructions from KIB that the soil inspector would not make the inspection and to backfill the holes. The crew then had to retrieve the equipment from the City of off again that evening to complete the backfill and cleanup site. They had to stay an extra night due to the delay and were not able to return to Kodiak via charter with supplies the next afternoon. Main Elementary new tank base form Initial work was to excavate for footing of tank foundation for pad. During the excavation two power conduit lines were found which ran through the middle of the form. Matt was contacted and he came to the site to see, a couple of suggestions were made. He needed to consult the engineer for direction. In the meantime GA crew back filled hole to top of conduit with D3 and compacted. Matt then came back with instructions to put 4" C900 halves over the existing conduit to protect the lines. With this instructions GA crew had to re -dig under the conduit to expose all of it. The crew then placed the C900 over all of conduit. At this time more Dl was required because the level was raised to accommodate at least a 2" cover over the C900. The level of both pads had to be raised to new elevation to make new design accommodate the levelness of tank. The crew poured, stripped, and re -compacted the total dig with Dl to subgrade which was a 6'xl2'xl' hole. The step latter on the tank had to be extended two feet to accommodate the higher elevation of the tank.
