10 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND
I 1 BOROUGH ESTABLISHING A LIMITED MORATORIUM ON THE RECEIPT
12 OR PROCESSING OF APPLICATIONS, PERMITS, OR PENDING
13 APPROVALS PERTAINING TO MARIJUANA ESTABLISHMENTS

15 Section 1. Classification. This ordinance will not be codified.

I7 Section 2. Severability. If any provision of this ordinance or its application to any person or
18 circumstance is held invalid, the remainder of this ordinance and the application to other
19 persons or circumstances shall not be affected thereby.

21 Section 3. Effective Date. This ordinance shall be effective immediately upon adoption.

23 Section 4. Action. The Kodiak Island Borough Assembly finds the following.
24
25 WHEREAS, on November 4, 2014, the Alaskan voters approved a ballot measure legalizing
26 the use of marijuana, and, with a State license, the operation of marijuana establishments,
27 defined as cultivation, manufacturing, testing and retail facilities; and
28
29 WHEREAS, the initiative, which goes into effect on February 24, 2015, requires the State of
30 Alaska to begin accepting and processing applications for the registration of marijuana
31 establishments within one year of the effective date of the act; and
32
33 WHEREAS, the initiative authorizes local governments to enact legislation concerning the
34 time, place, and manner related to the operation of registered marijuana establishments, or the
35 prohibition of marijuana establishments; and
36
37 WHEREAS, it is in the public's best interest that the Kodiak Island Borough Assembly
38 thoughtfully consider and adopt legislation regulating marijuana establishments within the
39 Kodiak Island Borough; and
40
41 WHEREAS, the purpose of this moratorium is to allow the Kodiak Island Borough a
42 reasonable period of time to consider and enact legislation concerning the operation of
43 commercial marijuana establishments in the Kodiak Island Borough.

47 NOW,THEREFORE, BE IT ENACTED BY THE KODIAK ISLAND BOROUGH ASSEMBLY:
48 Moratorium. The Kodiak Island Borough shall accept no development permit application,
49 proposal, or other documentation for a similar purpose, nor act on pending applications,
50 proposals, or documentation for a similar purpose, pertaining to marijuana establishments,
51 including marijuana cultivation, testing, and product manufacturing facilities and marijuana retail
52 stores. The prohibition imposed by this section shall remain in effect until September 1, 2016.
