15 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
16 REPEALING ORDINANCE NO. 98-06 RESERVING CERTAIN BOROUGH
17 LANDS AS A VEGETATIVE SCREEN, AND RESERVING AN AMENDED
18 GREENBELT BUFFER ALONG THE COMMON BOUNDARY OF THE
19 MONASHKA BAY ROAD SERVICE AREA AND THE KODIAK ISLAND
20 BOROUGH BALERILANDFILL

22 WHEREAS, the Monashka Bay Road Service Area shares a common boundary with the
23 Kodiak Island Borough Landfill site; and
24
25 WHEREAS, the Monashka Bay Road Service Area requested the Kodiak Island Borough to
26 restrict activities along a two hundred (200) foot common boundary of the service area and Lot 2
27 of the Kodiak Island Borough Landfill Subdivision; and
28
29 WHEREAS, the Kodiak Island Borough assembly has adopted prior Ordinances No. 87-15-0
30 and No. 98-06, reserving certain Borough lands as a vegetative screen, greenbelt and buffer
31 area; and
32
33 WHEREAS, the Monashka Bay Road Service Asea borough approved a request to build a
34 new wastewater treatment facility that effectively improves upon and effectively replaces the
35 former bioremediation pond and swale that were included within the reserved vegetative screen,
36 greenbelt and buffer area; and
37
38 WHEREAS, the operation of the wastewater treatment facility is an industrial land use in a re-
39 platted portion of the landfill that is now zoned for industrial land uses, which makes it
40 appropriate to adjust the boundary of the reserved vegetative screen, greenbelt and buffer area
41 to exclude this facility going forward; and
42
43 WHEREAS, the zoning of Lot 2, Kodiak Island Borough Landfill Subdivision is now NU-
44 Natural Use which encourages the passive recreation use of land and prohibits the motorized
45 use of trails and which may also suggest some further changes to the characterization of the
46 reserved area in the context of prior greenbelt buffer ordinances;

48 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
49 BOROUGH THAT:

51 Section 1: This ordinance is of a general and permanent nature and shall not become a part
52 of the Kodiak Island Borough Code of Ordinances;

55 Section 2: Ordinance No. 98-06 is hereby repealed in order to be reenacted by this
56 ordinance to reserve a greenbelt buffer (Exhibit 1) along the common boundary
57 of the Monashka Bay Road Service Area and Lot 2 of the Kodiak Island Landfill
58 Subdivision described as follows:
