FY2016-10 <br /> 8 <br /> 9 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND <br /> 10 BOROUGH AMENDING THE 2008 COMPREHENSIVE PLAN BY <br /> 11 CHANGING THE FUTURE LAND USE DESIGNATION OF LOT 1, <br /> 12 SAWMILL SUBDIVISION FROM OPEN SPACE/RECREATION TO <br /> 13 INDUSTRIAULIGHT INDUSTRIAL (P&Z CASE NO. 16-003) <br /> 14 <br /> 15 WHEREAS, as a second class Borough, the Kodiak Island Borough excercises <br /> 16 planning, platting, and land use regulations on an area wide basis pursuant to Chapter <br /> 17 29.40 Alaska Statutes; and <br /> 18 <br /> 19 WHEREAS, in accordance with AS 29.40, the Kodiak Island Borough adopted the 2008 <br /> 20 Comprehensive Plan update on December 6, 2007 (Ordinance No. FY2008-10) to replace <br /> 21 the 1968 Comprehensive Plan; and <br /> 22 <br /> 23 WHEREAS, the Kodiak Island Borough has adopted KIBC Title 17 (Zoning) in <br /> 24 accordance with AS 29.40 to implement the Kodiak Island Borough Comprehensive Plan; <br /> 25 and <br /> 26 <br /> 27 WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, <br /> 28 convenience, general welfare or good zoning practice requires, the assembly may, by <br /> 29 ordinance and after report thereon by the commission and public hearing as required by <br /> 30 law, amend, supplement, modify, repeal or otherwise change these regulations and the <br /> 31 boundaries of the districts;" and <br /> 32 <br /> 33 WHEREAS, the Planning and Zoning Commission received a request to amend the <br /> 34 2008 Comprehensive Plan by changing the Future Land Use Designation of Lot 1, Sawmill <br /> 35 Subdivision; and <br /> 36 <br /> 37 WHEREAS, at an advertised public hearing, consistent with Kodiak Island Borough <br /> 38 Code 17.205.040, the Commission considered the merits of the Comprehensive Plan <br /> 39 amendment request; and <br /> 40 <br /> 41 WHEREAS, the Commission voted to recommend to the Borough Assembly that the <br /> 42 Comprehensive Plan Future Land Use Designation of this lot be changed finding that the <br /> 43 public necessity, convenience, general welfare, and good zoning practice would be <br /> 44 enhanced by such action; and <br /> 45 <br /> 46 WHEREAS, the Commission hereby recommends that this 'amendment request be <br /> 47 reviewed and approved by the Borough Assembly. <br /> 48 <br /> 49 <br /> Kodiak Island Borough„Alaska Ordinance No. FY2016-10 <br /> Page 1 of 2 <br />
