Ken Sikora opposed to leases for the simple reason that the Borough has stated that ..-_-
they are unable to maintain leases. Borough does not have the policing powers to
keep everything cleaned up.
Mrs. Crowe closed the public hearing and reopened the regular meeting.
Mr. Ball Mr. Johnson requested sale but the Planning and Zoning Commission
the lease. What is the topography of Johnson's land?

Mrs. Crowe yes, we recommend to the Assembly.
Mr. Ball moved to approve a request for lease of Borough owned land on Section 2, _
portion of KIB 12, material site along Russian Creek Alaska Subdivision. Seconded
by Mr. Gudenau. Motion FAILED by unanimous roll call vote.
Mr. Ball moved to recommend to the Borough Assembly that they dispose of land on
Section 2, portion of KIB 12, material site along Russian Creek Alaska Subdivision
at an out cry auction as the value for the homesite may not be realistic and if the
exceeds the negotiable limits it would have to go to public auction. Second- °z> v
ed by Mr. Gudenau. Motion PASSED by unanimous roll call vote.
PUBLIC HEARING ON CASE LL -81 -003. A request for a land lease on lot 1, block 5,

STAFF REPORT: Mr. Walton presented the staff report based on a memorandum prepared
the Community Development Department which recommended tabling until the Borough
has a land sale. z5=~"
Public hearing was held under Case LL -81 -002.
Mr. Hill 'moved to grant a request for a land lease on lot 1, block 5,—Tract A,
Bells Flats Alaska Subdivision. Seconded by. Mrs. Strickert. Motion FAILED by
unanimous roll call vote.
6. PUBLIC HEARING ON CASE LL -81 -004. A request for land lease on Section 31, T28S,
R2OW, in KIB 12. (Rickie Walker)
STAFF REPORT: Mr. Walton presented the staff report based on a memorandum prepared
by the Community Development Department which recommended denial of the request.
Mrs. Crowe closed the regular meeting and opened the public hearing.
Dan Bayne should not be lease ever as it is right on the land, no sewer facilities
no access. Against the request.
Barbara Mcaheiveir opposed. When the river is high it could flood, sewer problem.
Janet Atwood opposed.
Ricki Bayne why no rules for floodplain?
Mr. Walton a few years ago alot of work was done on floodplains within the City
and Borough which were then designated on official maps and the next step was to
have the maps adopted by the Borough Assembly and have appropriate regulations
adopted.
Ricki Bayne I think it should be finished by the Assembly.
Mrs. Crowe it wouldn't be out of, line for the Woman's Bay Community to send a
letter to the Borough Assembly and ask them to bring it up for reconsideration or
to consider appropriate legislation to cover this type of situation.

As property owners in the Russian Creek Subdivision, we protest
the lease of the petitioned area, (Section 31, T28S R2OW) in
Kodiak Island Borough 12.
We further protest any future lease or sale on any property listed
as State of Alaska Department of Highways, as shown on the map
.included with the petition from Rieke Walker.
Pertaining to the aforementioned petition, we categorically
object for the following reasons:
(1) There is at present no access to this property, and if
lease be granted, access wouldhaVe to be gained by crossing
Borough land or already privatly owned land.
(2) Property that is petitioned is not of sufficient distance
from the dry creek bed, which at high water, runoff filters through
this creek bed. Many property owners downstream from this area
depend ofl this flow of water, for drinking purposes. Hence the
Petitioned area is to close to this source of water for adequate
sewage facilities.
(3) This property if leased or sold would prohibit access
to the pond or river behind it, which has been for recreational
purposes for an extended period of time.
(4) Leasing property is tantamount to disaster. In the past,
leases have changed hands so quickly, •that virtually no control is
kept on property or scenic Aspects of property.
Little or no refuse control is maintained and the property.
becomes less than desireable.
(5) Most people in this area paid very high prices for theAr
properties. They did so freely because of the natural beauty
of the 4rea. I must stress, the scenic aspects of the area was one
of the main factors involved in the prices of surrounding properties
being so high. Leasing as said before will destroy this natural
Beauty. •
(6) it is important that it is understood that we do not wish
for any lease situation, in any way, shape, or form, however the
mere fact that land owners in this area had no option to lease
their land, but rather were required to bid on it in open public
auction, is contradictory and unfair..
In closing, our reason for this written protest is to-keep this
section of land,(including petition land and surrounding area) in a
state of being, that it be kept for scenic and recreational purposes.
Further, any other leases, including the ones submitted by Theodore
Olafson (Lot-i Block 5, Tract A ) and Gary A. Johnson (Section 2
T2YS, R21W, Seward. Meridian) Should be similarly disapproved.
We, the undersigned have read the written protest of Mr. Cy F. Hoen, and
fully agree and support him in his efforts. Therefore, we are requesting
that the leases specified in his request not be approved.

REQUEST
Mr. Ted Olafson is •requesting a one year lease for Borough owned
property described as lot 1, block 5, Bells Flats Alaska Sub-
division for "crab pot storage and manufacturing". Mr. Oiafson
states in his application, "construct a 12' x 20' wood building
which will be used for storage of materials and equipment.
The remainder of the area will be used for crab pot storage.
The storage will be sub-leased to crab pot owners."
PROPERTY
The parcel contains 3.58 acres and is zoned I-Industrial.
The proposed use is-permitted.
COMMENTS
Dale Tubbs, Borough Land Consultant, recommends that this parcel
and the others owned by the Borough in blocks 4 (lots 1 and 2)
and 5 (lots 1-4) be offered for sale at public auction. With
our shortage of industrial land it_is important for appropriate
Borough owned lands to be placed in private ownership as soon
as possible. With the Womans Bay Community Plan nearing com-
pletion it is appropriate for that document to be in place
before any Borough land disposals in that community are initiated.
The Borough Assembly has tabled further consideration of action
on the 8 Tracts until the plan is completed.
The Womans Bay Community Plan is scheduled to be presented to
the Commission in December. Final map changes are being proposed
by the Community and the text is being prepared.

A
As mentioned in my letter dated September 17, 1981, this
request will most likely exceed the negotiable limits, even
if it is for a one-year term.
This is one of three requests by Olatson for land in Bells
Flats. He has a five-year application K 675-for what is now
Lots 3 and 4 of Block 5, Tract A, and K 728 for Lot 4, Block
2 of Tract A, all in Bells Flats Alaska Subdivision. Needless
to say, the applicant wants a parcel of land. He has $75.00
tied up in application fees.
My recommendation remains the same. Offer the parcel for
sale at public auction. A .short-term lease for an enterprise
that does not intend to go out of business is a built-in
preference for a long-term disposal. A reoffering of a parcel.
that has the former lessee's improvements on it reduces or
eliminates fair competition.

all Of-the Kodiak Island Borough selected land at the•head of
Kizhuyak Bay,'. Their,application indicates an easement is needed
and the cover.letter is requesting the purchase of the-land.
The application should be reviewed, by you and the Manager

so you becothefamiliar with KEA's needs for the power plant,
etc. I did not get a:Copy of KEA's development plan to evaluate
their. actual needs. ' My 'off the cuff' comment would be the
entire area be managed to promote the hydro project, but not .
give KEA exclusive use of the whole area. In the end, .KEA should
be able,to IoOk for a negotiatepUrchase-of the area housing
-the powerhouse, pensteck, tailrace, and necessary-.building areas.
The powerline Will not have to be in fee ownership : It will
be covered by an easement. The road, except for areas Within, * -
the powerhousearea, will probably be public:easements. If
there is an-airStrip:or heliport in the plan, fee ownership
may be.best to relieve the Borough of maintenance and, liability.
All of these.disPesals Will-qualify for less than fair market
values as provided in18.20.1-00B and 18.40.0208 of the'KIB Code .
