Had several complaints concerning estethics and burning by
Studnek Const. Talked with local DEC rep. Ron Klein, who
suggested that USCG Env. Coord. J.C. Johnson be advised to
monitor the situation.
Dept. Dir. said that after last contact with Bruce Ericson,
the operation was OK'd to burn by DEC. If future complaints
are rec'd refer to DEC Anch., Air Qual. Dept.

Memorandum to file
Dave and Tom Studnek were copied with a stop work order from
Bruce Ericson of ADEC to halt the.demolition b4rning on Lot
3, Block 4, Tract A, Bells Flats Subdivision. It is not

permitted to burn any gypsum board, metals, wiring with V�'m«~|
insulation, roofing shingles or other hazardous materials. - (9140A'
(Mr. Ericson mentioned that bui-ingin shingles releases
friable asbestos.) Mr. Ericson said that since there did
not seem to be any intent to break the law he' would let the
matter go with only an NOV, Notice of Violation. He said
that the options remaining would be to dispose of all
demolition materials in an approved landfill, ie. the
Borough Landfill, or, to segregate all the material from the
demolition and burn only wood materials. Concrete footings
and foundations could be used for fill material as well.

The Studneks were interested'in gaining access to the
landfill at hours later than normal operating schedules.
Staff informed them that they would have to contact the

Dave Studnek called re the landfill activities reported
earlier by Mike Brechan. Staff explained that no
conditional use permit or DEC permit had been issued for
such activity and that it was a clear violation of the
zoning code., Staff explained that the understanding was
that Studnek��onstruction was going to continue to burn the
demolition materials, with the conditions that no black
smoke was to be produced and that there could be 116 smoke or'
dust creating a nuisance off-site.
Mr. Studnek acknowledged that he would discontinue
stockpiling the material and would begin burning once again,
subject to the conditions mentioned above. Staff said that
an on-site inspection would be made in two (2) days If the
site and demolition operation was in compliance then this
complaint would be closed.

Memorandum to file
On 4/10/89 Mike Brechan called to report building demolition
materials being placed in a land fill on Lot3, Block 4,
Tract A, Bells Flats Subdivision. He wanted to know if this
operation was being monitored by DEC and whether it was
approved by the Borough. He was upset because he had been
required to go through the process at a previous time for
his property at Block 3, Tract A. Mr. Brechan was informed
that staff would investigate and he would be contacted by
telephone at 486-3215 when there was something to report.

Called Mr. Omar Stratman, representative for the Cattleman's
Association, to see if the allegations were true. He was
not available. The receptionist at the Northland Ranch said
that he was not expected back until 8 P.M. this evening.
Requested that Mr. Stratman call me tommorrow morning,

Called Robert Flint at DEC Anchorage. He had no knowledge
of any landfill permit either issued or requested at the
location documented above. He suggested that I contact
Bruce Ericson, who is currently in Kodiak for the oil spill
effort. Maybe Mr. Ericson could investigate if there was

4/11/89 - Called Joe Studnek, Studnek Contracting in --- 1.1774--

Anchorage. He said that his son had a permit to do landfill
activities. Staff explained that there was no way he could
have a permit because a conditional.use permit is required
and that could only be approved by the Planning and Zoning
Commission. Staff explained that the resolution of the
earlier situation was that they would be permitted to burn
on the Industrial property, as long as they did not create a
nuisance. A basically permitted use which could be
terminated on days when the winds or atmospheric conditions
required it. Joe said that he would get a message to his
son Dave today to contact this office. He was very
cooperative and said that he would comply with Borough Code.

Re: Studnek Contractors burning of demolition materials
Dave Studnek came into the office this morning with Omar
Stratman of the Livestock Co-op to inquire about burning the
depmolition materials from Base housing on Lot 3, Block 4,
Tract A, Bells Flats Subdivision. This property is owned by
the Co-op, leased from the Co-op by Mr. Stratman, and zoned
industrial. Mr. Stratman indicated that he has no objection
to Studnek burning in a designated portion of this property.
I told them that burning was a permitted land use on
industrial property, and that the burning would be permitted
there as long as DEC requirements were met (ie., no asbestos
burned, no black smoke generated). I also pointed out Code
section 17.24.060.E, which prohibits dust and smoke from
industrial uses that create a nuisance. Mr. Studnek
indicated that he would ensure that all asphalt shingles
would be removed prior to burning as he feels that this. was
probably the source of the black smoke.
