Mr. Peotter moved to authorize expenditure not to exceed $2,500 for
removal of junk cars and covering of same. Seconded by Mr. Anderson.
Unanimous roll call vote.
Mr. Peotter moved to continue the Assembly Meeting until 11:45 P.M.. Seconded
by Mr. Herrnsteen. Motion carried unanimously.
7. Disposal of East Elementary trailer - School will advertise
Mr. Peotter moved to authorize the sale as layed out by the Manager.

Mr. Peotter moved to accept the low bid of $8,308 from Industry Services,
Inc. of Anchorage. Seconded by Mr. Herrnsteen. Motion carried with Mr.
Anderson voicing objection. Mr. Arndt was out of the room.
G. Akhiok School Proposal
Mr. Peotter moved to grant the fees to Mr. Ecklund as pointed out in his
letter for the vertical and horizontal positions of existing utilities
near the proposed school site, tie test pits as located by the soils
Engineer and tie existing surveys for photo control not to exceed $1,500.
Seconded by Mr. Wakefield. Unanimous voice vote.
H. Application -for Lease of Lt. 4, Blk.2 Bells Flats AKSubd. - Olafson
Mr. Peotter moved to approve the lease to Mr. Ted Olafson for $123.33
per year. Seconded by_ Mr. Wakefield. Motion failed by unanimous voice vote.
I. Application for Purchase of Gravel - Povelite
Mr. Herrnsteen moved to approve the sale of $1,000 worth of gravel from
site B -2. Seconded by Mr. Wakefield. Unanimous voice vote.

•The application for a negotiated lease of Lot 4, Blk 2,
Tract A of Bells Flats AK Subd. submitted by Mr. Ted Olafson
exceeds the negotiable limits established by ordinance.
Title 18.40.020 A states there must be no competitive interest
for the land and the rent cannot exceed $500.00 per year. Mr.
Olafson states in his cover letter that the assessed value
of the lot is $14,800. The borough has not established a
rental rate for either short term or long term leases. Mr.
Olafson has offered to pay $123.33 per year, this is equiva-
lent to 0.0083 in interest or eight/tenths of one percent
interest. I would assume this to be considerably below
market rental value. Also at this rental rate the competi-
tive interest would be tremendous.
This lot was considered for disposal in the December 1980
land sale but was withdrawn. by the Assembly along with all
•the other lots within Tract A. I assume the zoned, use of
this area is still to be resolved before any disposals can
be considered.
I recommend that any offering of the lot for private use be
by competitive bid.

years with an option to lease an additional five (5)/Years.
The assessed valuation of the property is $14^800 and I would
be willing to pay,u monthly rental of $123.33 or an amount
computed in accordance with the minimum lease payments in the
Borough's land disposal ordinance (18.40.030)
Should the Borough approve my leasing the land I plan to

18.40.010 Leasing procedures. Unless otherwise pro-
vided by an assembly resolution, the land leasing procedures
established by this title shall be utilized in the leasing
of any borough land. (Ord. 78-7-0 §2(part), 1978).
18.40.020 Negotiated leases. A. The assembly may ..
approve by resolution the issuance,of a negotiated lease
for a period not to exceed five years if the annual rental
value of the property is five hunded dollars or less and
no competitive interest for the property is apparent.
B. The assembly may approve by resolution the issuance
of a negotiated lease for a period not to exceed twenty-five
years to a nonprofit corporation or public utility at a
reasonable rental rate taking into consideration, the purpose
for which the real property is to be used.
% C. A nonprofit corporation applying for a negotiated
lease in subsection B of this section may be required to
provide the following:
1. A copy of its articles of incorporation in the
state of Alaska;
2. Verification it is exempt from paying federal
and state income tax;
3. Provide a use plan to verify the need—of the
real property requested;
4. Provide a statement of public service being
provided to the community and its availability for enjoyment
by all citizens of the Kodiak Island Borough.
D. No lease issued as provided in subsection B of this
section may be assigned or subleased except with the consent
of the assembly, and in any case may only be transferred to an
applicant eligible under subsection B of this section. If •
the real property is devoted to a use other than that for
which it was leased without consent of • the assembly, the
lease automatically terminates. (Ord. 79-19-0, 1979: Ord.
78-7-0 §2(part), 1978).

18.40.030 Term of lease. Leases may be issued for a
period not to exceed fifty-five years. The term of any
given lease shall depend upon the desirability of the pro-
posed use, the amount of investment in improvements pro-
posed and made, and the nature of the proposed improvement'
with respect to durability and time required to amortize
the proposed amendment. (Ord. 78-7-0 §2(part), 1978).
18.40.040 Terms and conditions of leases. The pro-
visions of this chapter and all other applicable provisions
of this code are binding as terms and conditions of any
lease of borough land. These terms and conditions, if not
fully set forth in the lease, are incorporated by reference
as though fully set out in full in the lease. The lease
shall contain such additional terms, conditions, and re-
strictions as the borough determines to be in its best
interest. (Ord. 78-7-0 §2(part), 1978).
18.40.050
inimum acceptable annual rental. A. Annual
minimum rentals shall be computed at the prevailing interest
rate used in the conventional mortgage market in Kodiak,
based on the appraised fair market value for the land and/or..
improvement rights being leased. This minimum shall be the
lowest acceptable bid in the event of an auction, lease by
sealed bid, or negotiated lease.
