We would not wish for you to construe that our firm is against
religion in any way, shape, or form. However, we must state
that we are against the exceptions to permitted uses for allow-
ing too many exceptions to zoning matters in the past and this '
is just another case which changes the whole complexion of the
industrial zoning in Bells Flats.
We are certain there are other areas available for church services
in the area and secondly you should be aware that at times it is
necessary for us to work on Sundays during the short Alaskan
construction season.

RE: CASE 84-008. Request for an exception on Lot 3, Block 4,
Tract A, Bells Flats Alaska Subdivision (Berean Baptist Church).
Sixteen (16) public hearing notices were mailed on January 31, 1984.
1. Applicant: Berean Baptist Church, Box 1065, Kodiak, AK.
2. Land Owner: Kodiak Livestock Co-op, Box 273, Kodiak, AK.

3. Request: An exception from Section 17.24.010, Permitted Uses.
4. Purpose: To provide church services at the co-op's slaughterhouse for
a period of two years.
5. Existing Zoning: Industrial.
6. Zoning History: The 1968 Comprehensive Plan does not address the
development of Bells Flats. In 1969, Ordinance 69-30-0 zoned all of
Tract A as Industrial, because of the presence of gravel extraction sites.
7. Location: Lot 3, Block 4, Tract A, Bells Flats Alaska Subdivision.
No physical address has been assigned.
8. Lot Size: 27.85 acres.
9. Existing Land Use: Slaughterhouse/Meat processing.
10. Surrounding Land Use and Zoning:
North: Tract A, Block 3, Bells Flats AK Subd. is zoned I; Use, I
(Brechan Enterprise);
South: Tract A, Block 4, Lot 2, Bells Flats AD Subd. is zoned PL;
Use, vacant (Kodiak Island Borough);
East: Tract E of Tract A, Bells Flats AK Subd. is zoned I;

11. Comprehensive Plan: The 1968 comprehensive Plan does not address
Bells Flats.
12. Applicable Regulations: Chapter 17.24`, Industrial Uses,
Section 17.24.010, does not allow church activities in an Industrial
District.
COMMENTS:
This property was deeded to the Kodiak Livestock Cooperative, Inc. by the
Kodiak Island Borough on February 13, 1980, with the following condition:
...a slaughterhouse and /or agricultural research facility be
maintained thereon and that the proceeds from any additional use
of the property be used for the operation and maintenance of the
slaughterhouse and /or agricultural research facility; and in the
event that the property, or proceeds from the use thereof, are
not used as aforesaid, grantor and its successors and assigns may
re -enter and repossess the premises, terminating the estate of
grantee therein.
RECOMMENDATION:
Staff recommends approval of this proposal with the following conditions:
1. That the exception be granted for the requested two -year period;
and
2. Any proceeds derived from church activities held on the property
should be used for the operation and /or maintenance of the facility in
accordance with the deed dated February 15, 1984

MS.FREED reported.receiving three telephone calls from people

opposing this rezoning, 'CHAIRMAN GREGG then recessed the Regular Meeting
and opened the,Public Hearing.
STAN THOMPSON, representing himself and his wife who are tenants on
Lot 9, Block 1, Island Lake Subd., was present and voiced objection to the
rezoningA-equest. Mr. Thompson, who has a contract to purchase Lot 9 from
•'Mr.-.*H.J.-Woodworth; stated the lots were too small to be practical for
multiple-family dwellings.

MS. SHANNON BACH, Lot 2,-Block 3, Island Lake Subd.,.presented the
Commission with written testimony from several neighboring property owners,
all in opposition to the rezoning request. MS. Bach felt the lots/Were too
small and the road system inadequate, and she did not want to have more
people in the area. She requested no further "spot" zoning until.an over-
' all view could be taken of the Island Lake area. -
MRS. LORNA-LEE ARNDT was present and stated her request was in con-
formance with the rest of the zoning in the area.- Mrs. Arndt spoke favor-
ably of the present road system, stating they were wider than any others in
the area. Mrs. Arndt did not-feel that this rezoning would create any more
people in the area than what.the area was presently experiencing.1
MR. SCOTT ARNDT, adjacent property owner, was present and stated no
- objection with R2 -zoning in the area. Mr. Arndt-also-felt the present road
system was adequate to meet the needs of.the area.
MS. FREED read into the record the additional letters of objection
received prior to the meeting from: Mr: John Lund; Ms. Judy Van Fleet;
Gene & Sheila Black; and Patricia and Bruce Putnam. As there were no
further audience comments, CHAIRMAN GREGG closed the Public Hearing and
reconvened the Regular Meeting.
COMMISSIONER CROWE MOVED TO RECOMMEND THE REZONING of Lot 7 through
12B, Block 1, Island Lake Subdivision, U.S. Survey 3219, from .R1 to R2.
Commissioner Rennell seconded the motion and the question was called. The
motion FAILED by unanimous roll call vote.
FINDINGS OF FACT AND REASONS FOR DENIAL from the Commissioners were:
no present need to rezone; a two-acre minimum criteria for rezoning had not
been met; the total area of all the lots proposed for rezoning was less
than the two-acre minimum criteria; public testimony indicated a desire for
the character of the area to remain rural; and the rezoning would. impact
the area traffic and density.
MRS. CROWE MOVED TO APPROVE THE FINDINGS OF FACT AND REASONS FOR
DENIAL. The motion was seconded and the question called. The motion
CARRIED by unanimous roll call vote. CHAIRMAN GREGG informed Mrs. Arndt of
her right to appeal within ten days to the Borough Assembly.
B):CASE-84:008_. Request for an exception from Section 17.24.010,
Permitted Uses, to allow Sunday church service in the Kodiak Livestock Coop
building for a period of two years on Lot 3, Block 4, Tract A, Bells Flats
Alaska Subdivision (Berean-BaptistbrCh-).
MS. FREED corrected Item #2 of the February 3, 1984 staff report:
"Any proceeds derived from church activities held-on the property should

with the deed dated February 15, 1980."
CHAIRMAN GREGG recessed the Regular Meeting and opened the-Public
Hearing. As there were no audience comments, CHAIRMAN GREGG closed the
Public Hearing and opened the Regular Meeting.
COMMISSIONER CROWE MOVED TO GRANT A REQUEST FOR AN EXCEPTION on Lot 3,
Block 4, Tract A, Bells Flats Alaska Subdivision, contingent on the
following conditions:
1) That the exception be granted for the requested two-year period
and be non-renewable;

Ceoperative, Inc..for thp:-,use of this premises." COMMISSIONER RENNELL'
SECONDED the motion and'the question was called. The motion CARRI'ED:by
unanimous roll call vote. •
C) CASE 84-009.. Request for a variance from Section 17.18.050,
Yards, to allow the construction of a single-family residence in a
Single-Family Residential District (R1) that encroaches into the required
front yard setbacks on Lot 4A, Block 2, Leite Subdivision, 1516 Ismailov
Street (Allan Grauel).
As there was no additional staff report, CHAIRMAN GREGG recessed the
Regular Meeting and opened the Public Hearing. There were no audience
comments and CHAIRMAN GREGG closed the Public Hearing and reconvened the
Regular Meeting.
COMMISSIONER KNIGHT MOVED TO APPROVE A REQUEST FORA VARIANCE on
Lot 4A, Block 2, Leite Subdivision and the motion was seconded. The
question was called and the motion CARRIED by unanimous roll call vote.
. COMMISSIONER CROWE MOVED TO APPROVE AS FINDING-0F FACT AND REASONS FOR
APPROVAL:.
- 1. That the platted sewer easement presents an exceptional physical
circumstance-or condition applicable to the property or to its intended use
or development Which does not apply.generally to other properties in the
same land use district;.
2. That the strict application of the provisions of this title would
result in practical difficulties or unnecessary hardship;
3. That the granting of the variance will not result in material
damage or prejudice to other properties in the vicinity nor be detrimental
to the public's health, safety, or general.welfare;
4. That the granting of the variance will not be contrary to the
objectives of the comprehensive plan;
5. That actions of the applicant did not cause special conditions of
financial hardship or inconvenience from. which relief is being sought by a
variance; and
6. , That granting the variance will not permit a prohibited land use
in the district involved.
COMMISSIONER.RENNELL seconded the motion and the question was called.
The motion CARRIED by unanimous voice vote.
D) CASE 84-010. Request for-an exception from Section 17.19.020,
PermittedAseS,,toalLowtheponstructign of two additional apartments onto
an existing duplex with 'an office1n the garage in a Two-Family Residential
District (R2), located on Lot 67, Block 8, Erskine Subdivision, 424 Carolyn
Avenue.(Edward F. Randolph).
MS. FREED noted that a parking plan had been submitted by Mr. Randolph
and that had opportunity to revlew the plan. CHALRMAN-GREGG
recessed the Regular Meeting and opened the Public Hearing,
EDWARD F. RANDOLPH was present and spoke favorably . for granting the
request for an exception, stating that currently there were three other
lots being used on Carolyn Avenue in an R3-fashion. Mr. Randolph felt that
the use of these lots, although "grandfathered" into the current zoning
status in 1981, was significant to the request. Mr. Randolph submitted a
petition signed by 20-owners/tenants within a 400' radius of 424 Carolyn
who felt there would be no adverse conditions created by granting the
request.
THE COMMISSION questioned.Mr.i- Randolph and discussed his intended use
of the property. 'Ms. Freed noted Item-#3 of the February 15, 1984 staff

This Confirmation Deed made on February 13 , 1980, by
the Kodiak Island Borough, an Alaskan municipal corporation,
herein the grantor, to Kodiak Livestock Cooperative, Inc., an
Alaskan corporation, whose address is P.-0. Box 273, Kodiak,
Alaska 99615, herein the grantee.
RECITALS

1. Grantor conveyed to grantee by quitclaim deed dated May 13,
1971, and recorded in Book 24D at Page 106 in the records
of the Kodiak Recording District, Third Judicial District,
State of Alaska, a copy of which is annexed hereto and
incorporated by reference herein.
2. In the deed incorporated herein the following clauses were
set forth:
To have and to hold the above described real property
for use as a slaughterhouse facility. .
If it is determined by the grantor that the lands
described herein, are not used.by the grantee, for the
purpose of.a slaughterhouse facility said land shall
revert to the grantor.
The parties intended that the conveyance be subject to a
condition subsequent that a slaughterhouse -and/or an
agricultural research facility be operated and maintained
on the premises, but that this need not be the exclusive
use of the property, and that the proceeds from any
additional use of the property be used for the operation
and maintenance of the slaughterhouse and/or agriculturual
research facility.
3. To prevent difficulties hereafter and to permit recordation
of a deed that reflects the true intent of the parties in
every respect, the.parties desire to correct the clauses
quoted above by replacing them with the terms set forth
below.

Now, therefore, grantor, for and in consideration of the
sum of one collar. ($1.00), lawful money of the United States

quitclaims to grantee, subject to the condition hereafter
