Request for Conditional Use Permit to allow non - recreational resource extraction activities (mining) and related structures on C- Conservation zoned land on Sitkinak Island (KIBC 17.200 and 17.50.040.E). Dear Mr. Palkovich: The Kodiak Island Borough Planning and Zoning Commission at their meeting on June 18, 2014 granted the conditional use permit request cited above, subject to the following conditions: 1. 1. The conditional use permit shall be valid through December 31, 2018. If, within that term, State Mining Permit No. 5006 is revoked for any reason, the Conditional Use Permit shall expire on the date of that revocation. 2. Any increase in the scope or area included for this mining operation shall require a new Conditional Use Permit. 3. The mining operation shall comply with all other applicable federal, state, and local requirements. 4. Prior to securing the site for the off - season, reclamation work shall be completed on all mined areas, the fuel storage facility shall be properly secured, and all mining related equipment remaining on site shall be stored near the camp and plant area within ADL 534667. 5. Should the mining operation be abandoned for any reason, all mining related equipment, structures, and stored fuel shall be removed and the area returned to a natural state within one year of abandonment. A detailed site plan identifying all structures and the details of the fuel storage area shall be provided prior to zoning compliance being issued. Fast, effective spill response and cleanup will greatly reduce environmental damage caused as a result of a spill. Scope This SOP provides guidance to employees when responding to or cleaning up a spill of petroleum products (oil, diesel, gasoline, etc.) and other hazardous substances and to provide proper spill response procedures should a spill occur. Responsibility It is the responsibility of ALL employees to report a spill. If you see a spill, see evidence of a previous spill, you must report it to the mine manager. It is the responsibility of ALL employees, excluding kitchen staff, to respond to a spill. If a spill of >1 gallon is found that employee will notify the mine manager, who will then assign an employee to clean it up. If a spill of <55 gallons if found that employee will notify the mine manager, who will then assign ALL employees to clean it up. Environmental The potential consequences for not following the listed procedures include: • Contamination of the ground surface • Contamination of water, both surface and subsurface • Violations of our APMA • Violations of our mining license CbA 4 � • EPA violations and fines Definitions Mine manager: the person who is in control of day to day operations at the mine, employees will be informed to who this is at the beginning of every shift. Free Product: The liquid that-was sped (eg. Diesel) -- Spill: any fluid (other than water) being released to a location that was not intended. Not all spills need to hit the ground. A spill to a secondary containment system is still a spill, and the reasons for the spill need to be investigated and fixed. Spill Reporting 1. Any employee who encounters a spill, or evidence of a spill, MUST report it immediately. 2. If the spill is active, meaning the something is currently spilling, the employee MUST contact the mine manager and request help with the spill response. I If the location is safe, the employee MUST locate the nearest spill response kit and begin responding to the spill. 4. If the spill is not actively spilling, the employee MUST contact the mine manager and be available to show them where the spill is located. 5. The mine manager will assess the size of the spill and determine resources necessary for cleanup. Spill Response 1. The mine manager will assess the situation and request the necessary equipment and personnel required to respond to the spill. 2. Depending on the size and location of the spill response may include heavy equipment, spill kits, oil booms, granular absorbents, open top drums, or other equipment. 3. If an employee is called to respond to a spill, they must stop what they are doing (if it is safe to do so) and respond immediately. 4. The spill must be contained and all free product must be absorbed and disposed o€ 5. It is very important that the spill does not go into a water source (river, creek, stream, lake). Absorbent pads or rolls, granular absorbents, and diversion ditches can and should be used as necessary to prevent the spill from reaching water. Spill Cleanup 1. The mine manager will designate employees for spill cleanup. 2. All contaminated dirt or tundra must be dug up and collected in oily waste bags.
