FY2014-06 8 9 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND 10 BOROUGH REZONING TRACT A MARINE CENTER SUBDIVISION, 11 FROM RB — RETAIL BUSINESS ZONING DISTRICT TO B — BUSINESS 12 ZONING DISTRICT (P&Z CASE NO. 13-029, MARINE CENTER) 13 14 WHEREAS, the Planning and Zoning Commission received a request to rezone Tract A 15 Marine Center Subdivision, which is 2.5 acres in area; and 16 17 WHEREAS, at an advertised public hearing, consistent with KIB 17.205.040, the 18 Commission considered the merits of the rezone request; and 19 20 WHEREAS, the Commission voted to recommend to the Borough Assembly that this 21 tract be rezoned finding that the public necessity, convenience, and general welfare and 22 good zoning practice would be enhanced by such action; and 23 24 WHEREAS, the Commission hereby recommends that this rezone request be reviewed 25 and approved by the Borough Assembly. 26 27 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 28 BOROUGH THAT: 29 30 Section 1: This ordinance is not of a general and permanent nature and shall not 31 become a part of the Kodiak Island Borough Code of Ordinances. 32 33 Section 2: Tract A Marine Center Subdivision is hereby rezoned from RB—Retail 34 Business to B-Business. 35 36 Section 3: The findings of the Kodiak Island Borough Planning and Zoning 37 Commission are hereby confirmed as follows: 38 39 17.205.020 A. Findings as the Need and Justification for a Change or 40 Amendment. 41 The applicant in this case has identified an underserved constituency with 42 demands for goods and services not explicitly permitted in the RB-Retail Business 43 Zoning District. The efficient delivery of such goods and services is best enhanced Kodiak Island Borough, Alaska Ordinance No. FY2014-06 Page 1 of 2 44 by a location in the closest proximity available to the point of consumption, which is 45 the harbor. 46 47 17.72.020 B. Findings as to the Effect a Change or Amendment 48 would have on the Objectives of the Comprehensive Plan. 49 This request for rezone is consistent with the 1987 Near Island Comprehensive 50 Development Plan. This request for rezone is consistent with the 2008 Kodiak 51 Island Borough Comprehensive Plan Update. Rezoning the subject parcel to the B 52 — Business Zoning District will work towards achieving goals and objectives 53 identified in the 2008 Plan. Rezoning the subject parcel to the B — Business Zoning 54 District would represent the adjustment of an existing district's boundary only, not 55 the introduction of a new zoning district. 56 57 17.205.020 C. Recommendations as to the approval or disapproval of 58 the change or amendment. 59 This recommendation supports the change to an existing land use district 60 boundary only.
