FY2014-05 7 8 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND 9 BOROUGH REZONING A PORTION OF LOT 1 UNITED STATES 10 SURVEY 2539 FROM C-CONSERVATION TO RR1-RURAL 11 RESIDENTIAL ONE ZONING DISTRICT (P&Z CASE NO. 13-028, 12 KODIAK ISLAND BOROUGH) 13 14 WHEREAS, the Planning and zoning Commission received a request to rezone a 15 portion of Lot 1 USS 2539; and 16 17 WHEREAS, at an advertised public hearing, consistent with KIB 17.205.040, the 18 Commission considered the merits of the rezone request; and 19 20 WHEREAS, the Commission voted to recommend to the Borough Assembly that this 21 portion of Lot 1 USS 2539 be rezoned finding that the public necessity, convenience and 22 general welfare and good zoning practice would be enhanced by such action; and 23 24 WHEREAS, the Commission hereby recommends that this rezone request be reviewed 25 and approved by the Borough Assembly. 26 27 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 28 BOROUGH THAT: 29 30 Section 1: This ordinance is not of a general and permanent nature and shall not 31 become a part of the Kodiak Island Borough Code of Ordinances; 32 33 Section 2: A portion of Lot 1 USS 2539, described as Lots 1 and 2, Kashevarof 34 Heights Subdivision, is hereby rezoned from C—Conservation to RR1—Rural 35 Residential One. 36 37 Section 3: This rezone shall become effective upon the final recordation of the plat 38 subdividing a portion of Lot 1 USS 2539, creating Lots 1 and 2 Kashevarof 39 Heights Subdivision. 40 41 Section 4: The findings of the Kodiak Island Borough Planning and Zoning 42 Commission are hereby confirmed as follows: 43 44 17.205.020 A. Findings as the Need and Justification for a Change or 45 Amendment. 46 47 The community has expressed the need for additional residential land to be made 48 available for development purposes. The borough assembly has reviewed and 49 approved a number of surplus parcels for disposal. Some of these lots need to be 50 surveyed and zoned appropriately for residential development before they can be 51 included in a future land sale. Findings as to the Effect a Change or Amendment would 53 have on the Objectives of the Comprehensive Plan. 54 55 A rezone of the subject parcel(s) would be consistent with objectives of the 2008 56 Kodiak Island Borough Comprehensive Plan Update. A rezone of the subject 57 parcel would work to implement the Comprehensive Plan. 58 17.205.020 C. Recommendations as to the approval or disapproval of 59 the change or amendment. 60 The Kodiak Island Borough Planning and Zoning Commission recommends 61 approval of this rezone request.
