10 AMENDING KODIAK ISLAND BOROUGH CODE OF ORDINANCES TITLE 15
11 BUILDINGS AND CONSTRUCTION, CHAPTER 15.10 BUILDING CODES AND
12 CHAPTER 15.30 FIRE CODE TO UPDATE AND STANDARDIZE THE KODIAK ISLAND
13 BOROUGH CODE.

15 WHEREAS, the Joint Building Code Review Committee met with the building official in
16 2012 to consider revisions to the building codes; and
17
18 WHEREAS, the Joint Building Code Review Committee reviewed the 2012 International
19 Residential Code (IRC); and
20
21 WHEREAS, the Joint Building Code Review Committee reviewed the 2009 International
22 Building Code (IRC) and Appendix J, Grading; and
23
24 WHEREAS, the Joint Building Code Review Committee reviewed the 2009 International
25 Fire Code (IFC); and
26
27 WHEREAS, the Joint Building Code Review Committee reviewed the 2009 Uniform
28 Plumbing Code (UPC), 2009 International Mechanical Code (IMC), 2011 National
29 Electrical Code (IEC), and the 2009 International Fuel Gas Code; and
30
31 WHEREAS, the Joint Building Code Review Committee has recommended that the City
32 of Kodiak and the Kodiak Island Borough adopt updated building code editions; and
33
34 WHEREAS, the Joint Building Code Review Committee made the motions to adopt the
35 above codes with revisions as it applies to the Kodiak Island Borough Code, Chapter 15;
36 and
37
38 WHEREAS, the motion passed by a majority vote of the Committee.

40 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
41 BOROUGH THAT:

43 Section 1: This ordinance is of a general and permanent nature and shall become a
44 part of the Kodiak Island Borough Code of Ordinances;

110 The maximum riser height shall be 7-3/4 8 inches (496 203mm). The riser shall be
111 measured vertically between leading edges of the adjacent treads. The greatest riser
112 height within any flight of stairs shall not exceed the smallest by more than 3/8 inch (9.5
113 mm). Risers shall be vertical or sloped from the underside of the nosing of the tread above
114 at an angle not more than 30 degrees (0.51 rad) from the vertical, Open risers are
115 permitted provided that the opening between treads does not permit the passage of a 4-
116 inch - diameter (102 mm) sphere.

215 grading in an isolated area if there is no danger to private or public
216 property. For purposes of this section, a lot located in a recorded
217 subdivision shall not be considered an isolated, self- contained area.

219 2. An excavation below finished grade for basements and footings of a
220 building, retaining wall or other structure authorized by a valid building
221 permit. This shall not exempt any fill made with the material from such
222 an excavation or exempt any excavation having an unsupported height
223 greater than 10 feet after the completion of such structure.

225 8. An excavation which is (1) less than five (5) feet in depth, or (2) which
226 does not create a cut slope greater than ten (10) feet in height and
227 steeper than 1 1/2 horizontal to 1 vertical.

229 9. A fill less than five (5) feet in depth and placed on natural terrain with
230 a slope flatter than 3 horizontal to 1 vertical, not intended to support
231 structures, which does not obstruct a drainage course.

232 I Section 334-2.2 J106.1 Slope. The slope of cut surfaces shall be no
233 steeper than is safe for the intended use and shall be no steeper than
234 1/2 horizontal to one (1) vertical in solid rock and 2 horizontal to 1
235 vertical in other soils unless the permittee furnishes a soil engineering
236 or an engineering geology report, or both, stating that the site has been
237 investigated and giving an opinion that a cut at a steeper slope will be
238 stable and not create a hazard to public or private property. Where the
239 cut slope in rock exceeds thirty feet in height, a ten foot wide bench
240 shall be provided at twenty feet and at twenty foot intervals thereafter.
241 For slopes greater than 1 1/2 horizontal to 1 vertical, the adjacent
242 property line shall be fenced except along public right -of -way before
243 excavation is begun.

245 I Section 3313.2 J107.2 Preparation of Ground. The ground surface shall
246 be prepared to receive fill by removing vegetation, noncomplying fill,
247 topsoil and other unsuitable materials, scarifying to provide a bond with
248 the new fill and, where slopes are steeper than five to one, and the
249 height is greater than 5 feet, by benching into sound bedrock or other
250 competent material as determined by the soils engineer. The bench
251 under the toe of a fill on a slope steeper than 5 to one (1) shall be at
252 least 10 feet wide. The area beyond the toe of fill shall be sloped for
253 sheet overflow or a paved drain shall be provided. When fill is to be
254 placed over a cut, the bench under the toe of fill shall be at least ten feet
255 (10') wide but the cut must be made before placing fill and accepted by
256 the soils engineer and engineering geologist as a suitable foundation for
257 fill. Unsuitable soil is soil which, in the opinion of the building official or
258 the civil engineer or the soils engineer or the geologist, is not competent
259 to support other soil or fill, to support structures or to satisfactorily
260 perform the other functions for which the soil is intended.

262 I Section 3343 -5 J107.6 Slope. The slope of fill surfaces shall be no
263 steeper than is safe for the intended use. Fill surfaces shall be no
264 steeper than two horizontal to one vertical for soils other than fractured
265 rock and one and one -half horizontal to one vertical for fractured rock.

267 I Section 3316.1 J110.1 Slopes. The faces of cut and fill slopes shall be
268 prepared and maintained to control against erosion. This control may
269 consist of effective planting. The protection for the slopes shall be
270 installed as soon as practical and prior to calling for final approval.
271 Where cut slopes are not subject to erosion due to the erosion - resistant
272 character of the materials, such protection may be omitted. Any topsoil
273 available from any cut area shall be stockpiled and used to recover the
274 excavation site upon completion of grading and shall be seeded with
275 appropriate grasses.

308 suppression or alarm systems; and
309 5. Conditions affecting the safety of fire fighters and emergency responders during
310 emergency operations.
311 The fire codes so adopted shall be interpreted, administered, and enforced with the local
312 amendments hereinafter by a Manager appointed fire code official who is authorized to
313 take such action as may be reasonably necessary to enforce the purposes of this section.
314 The Manager may appoint or authorize an assistant or agent to the fire code official if
315 necessary to carry out the provisions of this section.
